OWNERS TO PLAY ACTIVE ROLE IN BUILDING MANAGEMENT
IN
THE BUILDING
WITH THE ENACTMENT OF THE MAIN PROVISIONS MANAGEMENT ORDINANCE, FLAT OWNERS CAN NOW PLAY A MORE ACTIVE AND RESPONSIBLE ROLE IN THE MANAGEMENT OF THEIR BUILDINGS.
THIS WAS STATED BY ASSISTANT SECRETARY FOR HOME AFFAIRS, JOHNNY CHAN, AT A SEMINAR ON BUILDING MANAGEMENT TODAY (SATURDAY).
MR
HE SAID THE MULTI-STOREY BUILDINGS (OWNERS INCORPORATION) ORDINANCE, AFTER DUE AMENDMENTS IN MAY THIS YEAR, HAD CHANGED ITS TITLE TO THE BUILDING MANAGEMENT ORDINANCE TO REFLECT PRECISELY ITS PURPOSES AND APPLICATIONS.
MR CHAN POINTED OUT THAT ONE OF THE OBJECTIVES WAS ΤΟ FACILITATE FLAT OWNERS TO FORM OWNERS' CORPORATIONS (OC'S) TO OVERSEE THE MANAGEMENT OF THEIR BUILDINGS.
IN ORDER ΤΟ ENHANCE FLAT OWNERS' SUPERVISION OVER THE MANAGEMENT COMMITTEE OF THE OC, IMPORTANT AMENDMENTS HAVE BEEN MADE TO PROVISIONS ON THE FORMATION AND OPERATION OF THE COMMITTEE AS WELL AS THE PROCEDURES OF CONVENING OC MEETING.
"THE MINIMUM NUMBER OF MANAGEMENT COMMITTEE MEMBERS HAS BEEN RAISED FROM THE RANGE OF THREE TO NOT FEWER THAN FIVE PERSONS TO THAT OF THREE TO NOT FEWER THAN NINE PERSONS, DEPENDING ON THE NUMBER OF FLATS IN A BUILDING.
"THIS PROVISION HAS ALLOWED GREATER PARTICIPATION REPRESENTATION OF OWNERS, MR CHAN ADDED.
AND
ON THE REMUNERATION OF MANAGEMENT COMMITTEE MEMBERS, НЕ SAID THE ORDINANCE HAD STIPULATED THAT SUCH ALLOWANCES SHOULD BE APPROVED .BY RESOLUTION PASSED AT A GENERAL MEETING OF THE CORPORATION IN ACCORDANCE WITH, BUT, NOT EXCEEDING THE MAXIMUM AMOUNT SPECIFIED IN THE FOURTH SCHEDULE.
THE BUILDING,
AS REGARDS FINANCIAL MANAGEMENT AND CONTROL OF MANDATORY TERMS ON HOW OC'S AND BUILDING MANAGERS SHOULD PROPERLY THEIR RESOURCES WERE ALSO INCLUDED IN THE ORDINANCE.
USE
MR CHAN SAID THE SECRETARY FOR HOME AFFAIRS HAD ISSUED A CODE OF PRACTICE UNDER SECTION 44 OF THE BUILDING MANAGEMENT ORDINANCE.
THE CODE STIPULATES THAT ANY SUPPLIES, GOODS OR SERVICES, THE VALUE OF WHICH EXCEEDS OR LIKELY TO EXCEED A SPECIFIC SUM, SHALL ВВ PROCURED BY INVITATION TO TENDER.
TURNING TO THE EXTENSION OF THE JURISDICTION OF THE EXISTING LANDS TRIBUNAL TO HANDLE DISPUTES OVER BUILDING MANAGEMENT MATTERS, MR CHAN SAID THE JUDICIARY STILL NEEDED TO FINALISE THE MANPOWER AND RESOURCES REQUIRED TO COPE WITH THIS ADDITIONAL WORK.
THE
"WHEN THE JUDICIARY HAS DECIDED ON THE ARRANGEMENTS, GOVERNMENT WOULD ANNOUNCE THE COMMENCEMENT DATE OF THE RELATED PROVISIONS AS WELL AS THE 10TH SCHEDULE,
