THE LABOUR DEPARTMENT HAS PROPOSED AN AMENDMENT ΤΟ EMPLOYMENT ORDINANCE TO EMPOWER THE COURT OR MAGISTRATE, UPON CONVICTION, TO ORDER THE EMPLOYER TO PAY COMPENSATION TO HIS DISMISSED EMPLOYEE WHO HAS GIVEN EVIDENCE AGAINST HIM IN COURT PROCEEDINGS.

THE PROPOSAL, WHICH IS INCLUDED IN THE EMPLOYMENT (AMENDMENT) BILL 1993 GAZETTED TODAY, HAS BEEN ENDORSED BY THE EXECUTIVE COUNCIL.

SPEAKING AT A MEET-THE-MEDIA SESSION THIS AFTERNOON, AN ASSISTANT COMMISSIONER FOR LABOUR, MR ALFRED CHAN, POINTED OUT THAT THE PROPOSAL FORMED PART OF THE DEPARTMENT'S CONTINUED EFFORTS TO PROVIDE BETTER PROTECTION TO WORKERS.

UNDER THE ORDINANCE, AN EMPLOYER IS PROHIBITED FROM DISMISSING HIS EMPLOYEE ON THE GROUND THAT THE EMPLOYEE HAS GIVEN EVIDENCE OR INFORMATION TO THE AUTHORITIES CONCERNED IN CONNECTION WITH THE ENFORCEMENT OF THE ORDINANCE OR BREACHES OF WORK SAFETY REGULATIONS.

AN EMPLOYER WHO CONTRAVENES THE PROVISION IS LIABLE TO A MAXIMUM FINE OF $20,000.

"HOWEVER, AN EMPLOYEE DISMISSED ON THIS GROUND MAY NOT BE ABLE TO GET COMPENSATION FOR HIS DISMISSAL EVEN THOUGH THE EMPLOYER IS BEING CONVICTED IN COURT,' MR CHAN SAID.
