ORDINANCE EMPOWERS FLAT OWNERS TO MANAGE BUILDINGS

BUILDING
MANAGEMENT
ORDINANCE GIVES POSITIVE RECOGNITION ΤΟ THE OWNERS RIGHT ΤΟ FORM CORPORATIONS FOR THE MANAGEMENT OF THEIR BUILDINGS.
THIS WAS STATED BY THE REGIONAL SECRETARY FOR HONG KONG AND KOWLOON, MISS CHRISTINE CHOW, AT A PUBLIC SEMINAR TODAY (SATURDAY).
SHE SAID THE TITLE OF THE MULTI-STOREY BUILDINGS (OWNERS INCORPORATION) ORDINANCE HAD NOW BEEN CHANGED ΤΟ THE BUILDING MANAGEMENT ORDINANCE, SO AS TO INDICATE MORE PRECISELY THE PURPOSE AND APPLICATION OF THE ORDINANCE.
MISS CHOW SAID THE NEW ORDINANCE CONFERRED ON FLAT OWNERS THE RIGHT TO INCORPORATE AND TO CONDUCT BUSINESS.
IT ALSO SETS OUT IN DETAIL THE CIRCUMSTANCES MANAGER'S APPOINTMENT MAY BE TERMINATED.

IN ADDITION, THE FREQUENCY OF MANAGEMENT INCREASED FROM AT LEAST ONCE EVERY SIX MONTHS TO AT LEAST ONCE EVERY THREE MONTHS.

MISS CHOW ADDED THAT THE ORDINANCE ALSO PROVIDED FOR MINUTES TO BE DRAWN UP FOR ALL MEETINGS AND DISPLAYED IN A PROMINENT PLACE IN THE BUILDING WITHIN 28 DAYS OF THE DAY OF A MEETING.
ON THE FINANCIAL MANAGEMENT AND CONTROL OF THE BUILDING, THE ORDINANCE CLEARLY SPECIFIES MANDATORY TERMS ON BUILDING MANAGERS ΤΟ ENSURE PROPER USE OF RESOURCES.
TURNING TO DISPUTES OVER BUILDING MANAGEMENT, MISS CHOW SAID A PROV ISTON HAD BEEN INCLUDED FOR AN EXTENSION OF THE JURISDICTION OF THE EXISTING LANDS TRIBUNAL TO HANDLE MATTERS BETWEEN OWNERS' CORPORATIONS AND MANAGERS, USE INTERPRETATION AND APPLICATION OF DEEDS OF MUTUAL BUILDING MANAGEMENT ORDINANCE.
