MR HO GAVE THE ADVICE AFTER A CASE IN WHICH AN EMPLOYER WAS CONVICTED OF FAILURE TO COMPLY WITH THE REQUIREMENT UNDER THE EMPLOYERS' COMPENSATION ORDINANCE.

THE CITY DRAINAGE CLEANING SERVICE WAS FINED $1,000 BY A KOWLOON MAGISTRATE FOR NOT PAYING AN INJURED EMPLOYEE HIS ENTITLED COMPENSATION FOR TEMPORARY INCAPACITY CAUSED BY A WORK ACCIDENT WITHIN A SPECIFIED PERIOD AFTER THE LABOUR DEPARTMENT ISSUED A CERTIFICATE OF COMPENSATION ASSESSMENT.

MR HO POINTED OUT THAT UNDER THE ORDINANCE, AN INJURED EMPLOYER IS ENTITLED TO PERIODICAL PAYMENTS DURING HIS PERIOD OF INCAPACITY AT A RATE OF TWO-THIRDS OF HIS MONTHLY EARNINGS, AND THE PAYMENTS ARE PAYABLE WITHIN SEVEN DAYS OF THE EMPLOYEE'S NORMAL PAY DAY.

"WHERE AN EMPLOYER OBJECTS TO THE AMOUNT OF COMPENSATION PAYABLE, THE LABOUR DEPARTMENT MAY ISSUE A CERTIFICATE TO BOTH THE EMPLOYER AND THE EMPLOYEE STATING THE AMOUNT OF COMPENSATION AND REQUIRING PAYMENT TO BE MADE WITHIN 21 DAYS," HE EXPLAINED.

ANY EMPLOYER FAILING TO COMPLY WITH THE PROVISIONS IS LIABLE TO A MAXIMUM FINE OF $10,000.

MR HO ALSO POINTED OUT THAT A NEW DIRECT SETTLEMENT SYSTEM HAS COME INTO OPERATION RECENTLY.

UNDER THE SYSTEM, AN EMPLOYER MAY ENTER INTO AN AGREEMENT, EITHER WRITTEN OR VERBAL, WITH HIS EMPLOYEE ON COMPENSATION FOR WORK – RELATED INJURIES RESULTING IN NO PERMANENT INCAPACITY AND INVOLVING SICK LEAVE OF NOT MORE THAN SEVEN DAYS, HE ADDED.
