THIS EXPANSION WOULD BE PHASED ACCORDING TO REQUIREMENTS AND THE PROVISION OF ADDITIONAL STAFF AND OTHER RESOURCES.

THE NEW DIRECTOR OF INTELLECTUAL PROPERTY WOULD ALSO BE RESPONSIBLE FOR PROMOTING HONG KONG'S IMAGE OVERSEAS IN THE INTELLECTUAL PROPERTY FIELD, PARTICULARLY AMONG ITS MAJOR TRADING PARTNERS, AND ALSO ITS CONCERN FOR PROTECTING INTELLECTUAL PROPERTY RIGHTS.

MR GLEESON SAID THE WORK OF THE NEW DEPARTMENT WOULD BE CHALLENGING AND EXCITING.

FURTHER IMPROVEMENTS TO LONG SERVICE PAYMENT DISCUSSED

THE LABOUR ADVISORY BOARD TODAY (MONDAY I CONSIDERED PROPOSALS FOR FURTHER IMPROVEMENTS TO THE LONG SERVICE PAYMENT (LSP) SCHEME UNDER THE EMPLOYMENT ORDINANCE.

ONE OF THE PROPOSED IMPROVEMENTS IS TO REMOVE THE DIFFERENTIAL RATES OF LSP BASED ON AGE UNDER AN IMPLEMENTATION PROGRAMME TO НЕ PHASED OVER TWO YEARS SO THAT ANY EMPLOYEE AGED BELOW 40 WILL EVENTUALLY ALSO BE ABLE TO RECEIVE THE FULL RATES OF PAYMENT.

AT PRESENT. EMPLOYEES AGED BETWEEN 36 AND 40 RECEIVE ONLY 75 PER CENT OF THE FULL PAYMENT WHILE THOSE AGED BELOW 36 RECEIVE ONLY 50 PER CENT.

ANOTHER PROPOSAL IS THAT PARTIAL ENTITLEMENT TO LSP SHOULD BE PROVIDED FOR AN EMPLOYEE WHO IS DISMISSED AND WHO HAS FIVE OR MORE YEARS OF SERVICE BUT LESS THAN THE QUALIFYING SERVICE REQUIRED UNDER THE EXISTING PROVISIONS OF THE ORDINANCE.

MEMBERS VIEWS ON THESE PROPOSALS WERE DIVERSE AND THE CHAIRMAN UNDERTOOK TO REFLECT THEM TO THE GOVERNMENT.

THE BOARD ALSO CONSIDERED SOME PROPOSED AMENDMENTS ΤΟ THE ORDINANCE AIMED AT CLARIFYING THE PROVISIONS CONCERNING SETTING OFF OF LSP OR SEVERANCE PAY AGAINST PAYMENT OP PROVIDENT FUND OR OTHER RETIREMENT BENEFITS TO ENSURE AN EMPLOYER WILL NOT HAVE TO PAY DOUBLE BENEFITS TO HIS EMPLOYEES.

MEMBERS AGREED TO THIS TECHNICAL AMENDMENT.

ALSO AGREED AT TODAY'S MEETING WAS A PROPOSAL TO REMOVE THE "CROSS-HARBOUR" PROVISION IN THE EMPLOYMENT ORDINANCE RELATING TO AN EMPLOYEE'S ENTITLEMENT TO SEVERANCE PAY UPON A CHANGE IN THE PLACE EMPLOYMENT.
