GUIDELINES DEFINE MANAGEMENT RESPONSIBILITIES

A NEW SET OF DRAFTING GUIDELINES SCHEDULED FOR IMPLEMENTATION ON DECEMBER 1, 1987, WILL ENSURE THAT NEW DEEDS OF MUTUAL COVENANT PROVIDE A MORE EFFECTIVE FRAMEWORK FOR THE BETTER MANAGEMENT OF MULTI- STOREY BUILDINGS, A SPOKESMAN FOR THE CITY AND NEW TERRITORIES ADMINISTRATION SAID TODAY (THURSDAY).

"THE GUIDELINES, TO BE REVIEWED AFTER ONE YEAR, WILL LIMIT THE PERIOD OF MANAGEMENT BY THE DEVELOPER TO TWO YEARS AND WILL CLEARLY DEFINE THE POWERS AND OBLIGATIONS OF THE MANAGER. A SCALE OF RENUMERATION FOR THE MANAGER WILL ALSO BE SPELT OUT AND THE MANAGER WILL BE REQUIRED TO LIAISE REGULARLY WITH THE OWNERS FOR BETTER COMMUNICATION PURPOSES," THE SPOKESMAN ADDED.

"THE GUIDELINES WILL REQUIRE A CLEAR DEFINITION OF COMMON PARTS AND THEIR PLANS TO BE ATTACHED TO THE DEEDS OF MUTUAL COVENANT, AND THE MANAGER WILL BE REQUIRED TO MAKE A CHINESE TRANSLATION OF THE DEEDS OF MUTUAL COVENANT AVAILABLE FOR THE REFERENCE OF THE OWNERS, HE SAID.

THE LAW SOCIETY OF HONG KONG WILL BE PLAYING AN IMPORTANT ROLE IN THE IMPLEMENTATION OF THE GUIDELINES WHICH HAVE BEEN TURNED INTO PRACTICE DIRECTION FOR LEGAL PRACTITIONERS.

"SOLICITORS WILL IN FUTURE HAVE TO FOLLOW THE GUIDELINES WHEN DRAFTING DEEDS OF MUTUAL COVENANT FOR ALL NEWLY CONSTRUCTED NON-INDUSTRIAL BUILDINGS, ARISING FROM BOTH NEW DEVELOPMENT AND REDEVELOPMENT, EXCEPT THOSE LARGE ESTATES FOR WHICH THE DEVELOPER GIVEN AN UNDERTAKING TO BE RESPONSIBLE FOR THE MANAGEMENT OF ESTATE FOR THE WHOLE OF THE LEASED PERIOD," THE SPOKESMAN NOTED.

THE SPOKESMAN EXPLAINED THAT 18 DISTRICT BOARDS, EXCEPT ISLANDS DISTRICT WHERE MULTI-STOREY BUILDINGS ARE UNCOMMON, THE LAW SOCIETY OF HONG KONG AND A NUMBER OF PROFESSIONAL INSTITUTIONS HAD BEEN CONSULTED BEFORE THE NEW GUIDELINES WERE DRAWN UP.
