EMPLOYERS, EMPLOYEES URGED TO HEED SAFETY DUTIES

THE LABOUR DEPARTMENT IS CONSIDERING PROPOSALS TO AMEND THE FACTORIES AND INDUSTRIAL UNDERTAKINGS ORDINANCE TO SPECIFY THE RESPECTIVE DUTIES OF BOTH THE EMPLOYER AND THE EMPLOYEE IN RESPECT OF SAFETY AND HEALTH IN THE WORKPLACE.
IT IS ALSO LOOKING INTO THE POSSIBILITY OF INTRODUCING PRISON TERMS FOR CERTAIN OFFENCES UNDER THE ORDINANCE, THE COMMISSIONER FOR LABOUR, MR TONY HAMMOND, TOLD A LUNCHEON MEETING OF THE ROTARY CLUB OF KOWLOON NORTH TODAY (FRIDAY).
MR HAMMOND STRESSED THAT WHILE VIGOROUS EFFORTS ON THE PART OF THE GOVERNMENT WERE ESSENTIAL, THEY ALONE COULD NOT ENSURE HIGH STANDARDS OF INDUSTRIAL SAFETY.
+IT IS EXTREMELY IMPORTANT THAT BOTH EMPLOYERS AND EMPLOYEES ARE ALSO CONSTANTLY AWARE OF THEIR RESPECTIVE DUTIES AND RESPONSIBILITIES IN THE FIELD OF INDUSTRIAL SAFETY AND HEALTH,+ HE ADDED.
OUTLINING THE DUTIES OF THE EMPLOYER, MR HAMMOND SAID, HE MUST1
* PROVIDE AND MAINTAIN PLANT AND SYSTEMS OF WORK THAT ARE
SAFE AND WITHOUT RISKS TO HEALTH;

MAKE PROPER ARRANGEMENTS TO ENSURE SAFETY IN THE USE, HANDLING, STORAGE AND TRANSPORT OF ARTICLES AND SUBSTANCES;
* PROVIDE SUCH INFORMATION, INSTRUCTION, TRAINING AND
SUPERVISION AS IS NECESSARY TO ENSURE THE SAFETY AND HEALTH AT WORK OF HIS EMPLOYEES I

MAINTAIN HIS PREMISES IN A SAFE CONDITION, AND KEEP THE PASSAGEWAYS AND EXITS FREE AND SAFE AND
* PROVIDE AND MAINTAIN A SAFE AND HEALTHY WORKING
ENVIRONMENT WITH ADEQUATE WELFARE FACILITIES.
AS REGARDS THE EMPLOYEE, MR HAMMOND SAID HE SHOULD:
* TAKE REASONABLE CARE WITH REGARD TO HIS OWN SAFETY AND HEALTH AND THAT OF OTHER PERSONS WHO MAY BE AFFECTED BY HIS WORK;

ADOPT SAFE WORKING PRACTICES AND OBSERVE THE SAFETY ARRANGEMENTS WHICH ARE MADE BY HIS EMPLOYER AND
* CO-OPERATE WITH HIS EMPLOYER AT ALL TIMES TO ENABLE
HIM TO FULFILL HIS DUTIES PROPERLY.
