THE ADVICE OF THE MEDICAL DEVELOPMENT ADVISORY COMMITTEE AND THE REHABILITATION DEVELOPMENT CO-ORDINATING COMMITTEE WILL BE SOUGHT TO ENABLE THE ADMINISTRATION TO DECIDE WHICH RECOMMENDATIONS SHOULD BE PURSUED, SUBJECT TO THE PROVISION OF SUCH RESOURCES AS ARE CONSIDERED NECESSARY.

AMENDMENT ORDINANCE TAKES EFFECT TOMORROW

ALL THE PROVISIONS OF THE EMPLOYEES' COMPENSATION (AMENDMENT) ORDINANCE 1982, EXCEPT THOSE RELATING TO COMPULSORY INSURANCE, COME INTO OPERATION TOMORROW (FRIDAY).
ANNOUNCING THIS TODAY, A SPOKESMAN FOR THE LABOUR DEPARTMENT AID THAT AMONG THE MAJOR PROVISIONS, ONE CONCERNS THE ESTABLISHMENT OF A TWO-TIER EMPLOYEES' COMPENSATION ASSESSMENT BOARD, CONSISTING OF AN ORDINARY ASSESSMENT BOARD AND A SPECIAL ASSESSMENT BOARD, IN ORDER TO IMPROVE THE EXISTING MACHINERY FOR ASSESSMENT OF LOSS OF EARNING CAPACITY.
ALL CLAIMS LIKELY TO INVOLVE PERMANENT INCAPACITY WILL BE REFERRED BY THE COMMISSIONER FOR LABOUR IN THE FIRST INSTANCE TO THE ORDINARY ASSESSMENT BOARD, WHICH WILL, IN MOST CASES, PROCEED TO ASSESS THE PERCENTAGE OF LOSS OF EARNING CAPACITY IN ACCORDANCE WITH THE SCALES LAID DOWN IN THE PRINCIPAL ORDINANCE.
IF THE ORDINARY ASSESSMENT BOARD CONSIDERS THAT SPECIAL ATTENTION HAS TO BE GIVEN TO SUCH FACTORS AS THE EMPLOYEE'S OCCUPATION, QUALIFICATIONS, PREVIOUS TRAINING AND EXPERIENCE, IT WILL REFER THE CLAIM TO THE SPECIAL ASSESSMENT BOARD, WHICH WILL ASSESS THE ACTUAL LOSS OF EARNING CAPACITY BY TAKING THESE FACTORS INTO CONSIDERATION.
BOTH BOARDS ARE EMPOWERED TO ISSUE +CERTIFICATES OF ASSESSMENT+.
IF AN EMPLOYEE HAS AN ACCIDENT, THE SPOKESMAN CONTINUED, THE EMPLOYER SHOULD NOTIFY THE DEPARTMENT'S EMPLOYEES' COMPENSATION UNIT BY MEANS OF A PRESCRIBED FORM (FORM 2) WITHIN SEVEN DAYS AFTER THE ACCIDENT.
ANY EMPLOYER WHO FAILS TO DO SO OR WHO PROVIDES INCORRECT OR MISLEADING INFORMATION IS LIABLE TO A MAXIMUM FINE OF $5 000.
THE SPOKESMAN POINTED OUT THAT THE ORDINANCE INTRODUCES A SIMPLER AND QUICKER PROCEDURE FOR SETTLEMENT OF MINOR CLAIMS INVOLVING TEMPORARY INCAPACITY OF NOT MORE THAN 14 DAYS.
