for the time being. The Arbitration shall be held in London and the Arbitrator shall have power to call for receive and act upon any evidence or information (whether oral or documentary and whether legally admissible as evidence or not) as he may consider necessary or relevant and in conducting the Arbitration and making his award he shall not be bound to follow the strict rules of procedure or evidence, Save as aforesaid the statutory provisions as to arbitration for the time being in force shall apply.

AGREEMENT WITH MR. RICHARD W. STARKEY FOR THE HIRE OF THE S.V. "CARL."
AN AGREEMENT made the sixteenth day of April One thousand nine hundred and fifteen BETWEEN the COMMISSIONERS for executing the Office of LORD HIGH ADMIRAL of the United Kingdom of Great Britain and Ireland (hereinafter called the Admiralty") of the one part and RICHARD WILLIAM STARKEY of Penmaen the Charterer") of the Hampton Wick Middlesex Merchant (hereinafter called other part.

1. The Admiralty will as soon as practicable procure the sailing ship “Carl (hereinafter called "the ship ") now at Cardiff to be registered as a Government ship and placed at the disposal of the Charterer for the purpose and upon the terms hereinafter mentioned.

2. The Admiralty will demise and the Charterer will hire the ship when so registered on monthly hire for the purpose of a voyage from Cardiff to Belize and thence back direct to any safe port in England between London and Liverpool (both On inclusive) South about which port is hereinafter called "the port of discharge." the outward voyage to Belize the vessel may carry cargo to any safe British port in the North Atlantic.
3. The Charterer shall pay to the Admiralty for the hire of the ship in cash in advance monthly at the rate of two hundred pounds per calendar month com- mencing on the date when the ship is placed at the disposal of the Charterer at Cardiff. All such monthly payments shall be made in London to the Assistant Paymaster-General for Supreme Court business at the Royal Courts of Justice and if the Charterer shall make default in any of such monthly payments the Admiralty may withdraw the ship from the service but without prejudice to any claim against the Charterer under this Agreement or otherwise. Should the ship be lost during the said voyage or be redelivered by the Charterer to the Admiralty as hereinafter provided during the currency of any calendar month any hire paid in advance and not earned (reckoning from the date of loss or of redelivery as the case may be) shall be returned by the Admiralty to the Charterer.
4. The Charterer shall not allow the ship to enter any enemy or neutral port or territorial waters (unless absolutely necessary for the safety of the ship or cargo) or to lie anywhere except afloat.
5. The Charterer shall on demand pay to the Admiralty the cost of insuring the ship for the said voyage for the sum of four thousand three hundred and seventy- five pounds so valued against all the risks covered by an ordinary Lloyd's policy on bull with Institute Clauses and full R.D.C. and also against War risks and all Protection and Indemnity and Employers' Liability and Workmen's Compensation risks. The Admiralty shall effect such insurance and in so far as the same shall provide indemnity in respect of any damage or salvage or other claim for which the Charterer may become liable to any third parties the Charterer shall be entitled to the benefit thereof. The Charterer shall not at any time. suffer the ship to sail on any stage of the said voyage in an unsea worthy condition nor do or suffer anything to be done whereby the said insurance would be vitiated or the right of recovery thereunder in any way affected.

Should the ship sustain any damage which may be recoverable under the said insurance the Charterer shall repair the same and shall furnish to the Admiralty an Average Statement with all usual particulars and documents showing the claim against the insurers in respect of such damage and the Admiralty shall thereupon present the claim to the insurers and pay to the Charterer the monies received from them in settlement thereof less the brokers' usual collecting commission. The Charterer shall take the ship in the condition in which she now lies at Cardiff and with all faults and shall keep her in good repair and condition and after the completion of the said voyage and the discharge of the homeward cargo shall redeliver her to the Admiralty at the port of discharge or (at the option of the Admiralty) at Cardiff in the same condition as she now is in fair wear and tear and any loss or damage recoverable under the said insurance always excepted. 8. The Admiralty shall have a lien on all cargo for the time being on board the ship for any hire due under this Agreement.
9. The Charterer shall not sub-charter the ship.
10. The Charterer and the Admiralty respectively shall take over and pay for at current market prices at Cardiff all provisions and stores which may be on board the ship at the commencement and completion respectively of the said voyage. 11. Subject as hereinbefore expressly provided the ship shall be at the abso- lute disposal and under the complete control and at the sole risk and expense of the Charterer for the said voyage.
12. No Member of the House of Commons shall be admitted to any share or part of this Agreement or to any benefit to arise therefrom.
13. Any difference whatsoever at any time arising between the Admiralty and the Charterer shall be referred to the sole arbitration of William Walton of Don- nington Holt Newbury Esquire or if he be dead or unable or unwilling to act then to a sole arbitrator to be appointed by the Chairman of Lloyd's for the time being.
