TELEGRAM.

No. 108. 11TH MAY. Confidential. It has not been possible to assent to all Bills passed by the Legislative Council before its dissolution on 17th April, 1931. One Bill has received my assent after dissolution and others await assent. I am advised that it is necessary to add to Article 3 of the State Council Order in Council in order to ratify assent after dissolution and to enable assent to be given to Bills awaiting assent. I would be glad to have authority to add by Proclamation under Article 97 (2) following provision to Article 3:-

Begins" It shall be lawful, and shall be deemed to have been lawful at any time after the commencement of this Order, for the Governor to assent to any Bill passed by the Legislative Council notwithstanding the revocation of the Orders in Council of 1928 to 1930, or the dissolution of the Legislative Council prior to such assent, and any Bill passed by the said Council which shall receive, or shall have received, the Governor's assent at any time after the commencement of this Order shall be, and shall be deemed to have been from the time of such assent, of the same force and effect as though at that time the said Council had been in existence and the Orders in Council of 1923 to 1930 had not been revoked."-Ends.

No. 99. CONFIDENTIAL. Your telegram of 11th May, No. 108.* I am not clear on what grounds you consider proposed provision necessary. Is it your opinion that you cannot assent to Bills because of revocation of previous Order in Council or because of dissolution of Council. If former, objection would apply even if Council still in existence. If latter, I have been advised in similar circumstances elsewhere that assent can be given although Legislature has been dissolved.-PASSFIELD.
