CHAPTER XXIX.-DAMAGE TO PROPERTY.
285.-Preliminary, Illegality, Part-Owner.
Nothing is an offence against this chapter unless it is done A. 336. without legal justification or excuse, and without claim, of B. 381. right.
Where such an offence consists in causing damage to any thing in which the offender has an interest, the existence of such interest if partial does not prevent his act being an offence, and if total does not prevent his act being an offence if done with intent to defraud.
286.-Setting Fire to Buildings, &c.
Any person who willfully sets fire to any building, or to any erection or structure affixed to the soil, whether com- pleted or not, or to any stack of cultivated vegetable produce, or of fuel, or to any mine or ship whether completed or not, is liable to penal servitude for life.

280.-Attempting to set Fire to Crops.
Any person who attempts to set fire to anything mentioned A. 340. in the last preceding section, and any person who sets fire to B. 385: any substance so situated that he knows that any such thing C. 464. is likely to catch fire therefrom, is guilty of felony; and also 24 & 25 V. of a simple offence.
290.-Damage to Buildings or Ships by Explosions.
Any person who by means of an explosion of any explosive A. 347 (a). substance, wilfully damages any building or ship is guilty of B. 386-7. felony; and
if he causes such explosion with intent to endanger the c. 97, 1.9, life of any person or the safety of such building or ship, 10, 45. he is liable to penal servitude for life.
Any person who wilfully causes an explosion of any explosive likely to damage any building or ship is guilty of a misdemeanour and also of a simple offence; and if he causes such explosion with intent to endanger the life of any person, or to do any damage to such building or ship, he is liable to fourteen years' penal servitude.

Any person who wilfully puts any explosive substance in any place so that the explosion thereof would be likely to damage any building or ship, is guilty of a misdemeanour and also of a simple offence; and if he acts as aforesaid with intent to endanger the life of any person or to damage any building or ship, he is liable to fourteen years' penal servitude.
291.—Damage to Railways.
Any person who, with intent to damage any railway or any engine, vehicle, goods, or property, on any railway, or to pre- vent the lawful use of any railway
(1) places anything on the railway; or
(2) deals with the railway or with anything whatever upon or near the railway, in such a manner as injuriously to affect or endanger the safe use of the railway, or the safety of any engine, vehicle, goods or property thereon; or
(3) shoots or throws anything at, into, or upon, or causes anything to come into contact with any engine, vehicle, goods, property, or person on the railway; or
(4) shows any light or signal, or in any way deals with any existing light or signal, upon or near the railway; or
(5) by an omission of any act which it is his duty to do, causes the safety of the railway or an engine, vehicle, goods or property thereon to be endangered;"
is liable to penal servitude for life.
Any person who wilfully
(1) and,in such a way as is likely to cause any damage to any railway, or any engine, vehicle, goods or property thereon, or to prevent the lawful use thereof does any of the acts or makes any of the omissions as aforesaid; or
(2) causes such damage to or prevents such use of the railway,
is guilty of a misdemeanour and also of a simple offence.
Any person who
292.-Damage to Ships.
(1) casts away or destroys any ship whether complete or unfinished; or
(2) does any act tending to the immediate loss or destruction of any ship in distress with intent to cause such loss or destruction; or
(3) interferes with any marine signal, or exhibits any false signal with intent to bring a ship or boat into danger, is liable to penal servitude for life.
Any person whg
•
(1) attempts to cast away or destroy any ship, whether complete or unfinished; or
(2) wilfully damages any ship in distress or wrecked, or any goods, merchandise, or articles belonging thereto,
is liable to fourteen years' penal servitude.
Any person who wilfully damages a ship, or any part thereof, with intent to destroy such ship, or to render it or any such part thereof useless, is guilty of felony.
