In reply to your despatch, No. 157, of the 18th ultimo, stating that flogging can only be inflicted in Cyprus for prison offences, I have the honour to call your attention to sections 17 and 18 of Ordinance No. 2 of 1878 "For the Regulation of a Force of Military Police," which empowers the Chief Commandant to order 50 lashes in certain cases; and I shall be glad if you will take the necessary steps to secure the amendment of this Ordinance, as suggested in the last paragraph of my despatch, No. 78, of the 9th June last.†

I HAVE the honour to submit, in triplicate, for the signification of Her Majesty's pleasure, an authenticated transcript of an Ordinance of the Legislature of this Colony, No. 19 of 1899, entitled "An Ordinance to regulate the law relating to sentences of flogging."

I would supplement this Report by informing you that, on receipt of despatch, No. 107. dated May 25th, 1899, I asked the Acting Attorney-General to advise me whether effect should be given to your wishes with regard to limiting the number of strokes in sentences of flogging by altering the law or by inviting the judges and magistrates of Sierra Leone to comply with them.

In reply he pointed out that the changes in the personnel of the judges and magistrates of the Colony were frequent, and he advised that "the safest way, perhaps the only safe way," to ensure your wishes being carried out was to alter the law.

Flogging Regulation Ordinance, 1899.

AN ORDINANCE to regulate the law relating to sentences of flogging.

In Her Majesty's name I assent to this Ordinance this 28th day of August, 1899.

Title.

Whereas it is expedient to regulate the number of strokes to be awarded by the Preamble. Courts of the Colony of Sierra Leone and the Protectorate thereof in sentences of flogging:

Be it therefore enacted by the Governor of the Colony of Sierra Leone, with the Enacting advice and consent of the Legislative Council thereof, as follows:-

clause.

1. This Ordinance may be cited for all purposes as "The Flogging Regulation Short title, Ordinance, 1899."

2. Where any sentence of flogging shall be passed upon any prisoner by any of the Maximum Courts of the Colony or Protectorate, or in pursuance of any Prison Regulation, the strokes to number of strokes to be awarded under such sentence shall not exceed twenty-four, and where in any such sentence the number of strokes is not mentioned it shall be deemed to tences of flogging. be twenty-four.

Passed in the Legislative Council, this Twenty-second day of August, in the year of our Lord One thousand eight hundred and ninety-nine.
