WITH reference to your instructions conveyed in the circular despatch noted in the margin, I have the honour to forward a return cf the cases of flogging in the prison here during the year 1897.

2. I am happy to say there was only one case, and since half the sentence was inflicted, the prisoner, who feigned madness, assaulted a warder and generally miscon- ducted himself, has behaved perfectly rationally,

2. With regard to the Court cases (a) it will be noticed that with one exception all the corporal punishments inflicted have been on juveniles. In most other Colonies there are reformatories and industrial schools, whereas in this Colony there are no such institutions, nor are they needed as yet. The almost universal practice in this Colony is not to send juveniles to prison where, in consequence of the absence of separate cells, they would have to mix with adult criminals, but to have them whipped. It is, I may state, the expressed opinion of the Chief Justice that the present practice of whipping juveniles under the provisions of sub-sections 77 (3), 78, 81 (2), and 138 (3) of the Criminal Code, should not be discouraged.

3. All the cases entered in Return (6), were submitted to the Governor, and corporal punishment was inflicted only after his consent had been given upon a review of all the circumstances.

4. As regards Return (c) it appears that in a letter dated the 11th August, 1897, the Inspector-General of Constabulary protested against the flogging of men in the Hausa force as being "totally against all regulations" (Epresume he referred to the fact that the force serving in the Hinterland had been placed under the provisions of the Army Act, 1881). I enclose a copy of the correspondence.

3. Return (d)-Kumasi.—Soon after my return from leave of absence on the 22nd October, it came under my notice that corporal punishment was being inflicted in the prison at Kumasi for breaches of prison discipline, without the consent of the Governor having been previously obtained, and I at once ordered that in future no such punishment was to take place until such consent had been given. Of this order the Governor verbally approved on his return to head quarters.

6. Altogether there were 72 cases of corporal punishment, which are classified as follows:-
