I HAVE the honour to enclose for your information, with reference to your Circular Despatch of 25th May last, a copy of a despatch from the Acting Resident. Commissioner, Basutoland, on the subject of the flogging of criminals.

The ASSISTANT COMMISSIONER,
IN transmitting the enclosed copy of circular, dated 25th May 1897, from the Secretary of State upon the subject of flogging convicts for your information, I am to remind you of the Basutoland Regulation No. 14, which provides that the punishment of whipping shall not be inflicted for any offence except rape.
The Resident Commissioner is aware that uuder rare circumstances an incorrigible prisoner has been whipped for prison violence or other grave breach of discipline after all other corrective resources had failed. But this punishment has presumably been inflicted after previous authority had been obtained from headquarters, and in the presence of the medical officer.
I am to direct that the spirit of the enclosed Regulations be observed in the matter of obtaining authority before inflicting corporal punishment, and as to its form.
(2) That a return be furnished (blank or otherwise), under Clause 4, for the 30th June last.
(3) That an annual return be furnished with each set of annual returns.

14th December 1897. WITH reference to the Secretary of State's Circular Despatch of the 25th May 1897 upon the subject of flogging criminals, I have the honour to enclose copy of a communication sent to all Magistrates in Basutoland for their guidance.
Returns of all floggings for the year ended 30th June last have been sent in from each district, and are embodied in the enclosed Territorial Return, which it will be observed is "Nil.'

I have the honour to acknowledge the receipt of your Lordship's despatch No. 42 of the 28th October last, forwarding a copy of a despatch from the Lieutenant- Governor of British New Guinea on the question of corporal punishment, together with a copy of the amended Prison Rules which it is proposed to issue on the subject.
I concur in the terms of the proposed Rules as sanctioned by your Lordship on the advice of your Ministers, &c.
