APPENDIX C to (2).
CONDITIONS OF SALE OF THE PRIZE STEAMER NICOLAOS."
I. THE highest bidder for the vessel shall be the buyer, and if any dispute arises as to any bidding the vessel shall be put up again at the last undisputed bidding. There will be a reserve price, and the Lords Commissioners of the Admiralty or their agents shall be at liberty to bid. The amount of the advance of each bidding shall be regulated by the auctioneers, and no bidding shall be retracted.
II. The buyer is to sign the agreement to purchase and to take the vessel, her tackle, apparel, furniture, and stores, including machinery and appurtenances, with all faults, in the condition in which they lie at the date of the sale, without any allowance or abatement for weights, lengths, qualities, quantities, errors of description, or any defects or injuries whatsoever, and neither the age, tonnage, description of the vessel, nor the description of the machinery, appurtenances and stores, as expressed in the inventories or printed particulars, are warranted.
III. The buyer is immediately to pay to the auctioneers one-tenth part of the purchase-money (and £2 2s. to the auctioneers for their fee) and (subject to the option hereinafter conferred of leaving part of the purchase-money on mortgage or guarantee) the buyer shall pay the balance of the purchase-money (together with the value of the stores, etc., mentioned in clause IV.) within fourteen days, in cash, in London, to the auctioneers, and upon such payment of the balance or so much thereof as may not be left on mortgage or guarantee, and on giving a mortgage, or guarantee, approved of by the Lords Commissioners of the Admiralty, for so much (if any) thereof as may be left as aforesaid, and subject to the stipulations contained in conditions X. and XI., the buyer will receive an order for the delivery of the vessel, her tackle, apparel and furniture, including machinery and appur- tenances as aforementioned. But in case of non-payment within such time of the balance of the purchase-money or so much thereof as may not be left as aforesaid, or in the case of any other breach by the buyer of, or failure by the buyer to comply with, these conditions, the aforesaid one-tenth part shall be and is hereby declared to be forfeited, and the vessel, her tackle, apparel and furniture, including machinery and appurtenances, may again be exposed to and sold at public or private sale, and the deficiency, if any, by such resale, shall be made good by the defaulter at this sale, together with the expenses attending such resale, and neither the Lords Commissioners of the Admiralty, nor any official of the Admiralty, nor of the Oversea Prize Disposal Committee, nor the auctioneers, shall be liable for the money paid in part and forfeited as aforesaid, but the defaulter shall be liable for all loss, costs, and damages which may arise by his default.
All unbroached provisions, paints, oils, and other consumable stores, and any bunker coals remaining on board at time of delivery, shall be paid for by the buyer at the current market prices ruling at the port of delivery.
IV.
V. If delivery of the property to an agent is required, such agent must produce the buyer's written authority to that effect, duly signed and addressed to the Secretary of the Oversea Prize Disposal Committee. Colonial Office, Downing Street, S.W.
VI. In order to prevent detention of the vessel for non-payment of dock or other dues, the buyer must give three days' notice to the Secretary of the Oversea Prize Disposal Committee, or to the auctioneers, of the day on which he will complete the purchase.
VII. The vessel will be sold as a registered Government ship, and on payment of the balance of the purchase maney, or so much (if any) thereof as may not be left as aforesaid. the buyer, if he requires it, may have a bill of sale in the pre-/ scribed form from the Lords Commissioners of the Admiralty. desire the vessel to remain on the British Register, he will have to furnish the Should the buyer Board of Trade with particulars of her dimensions, displacement, tonnage, etc.. and to comply with all the requirements of the Board as to measurement, etc., and to give an undertaking to do so as soon as practicable.
VIII. The vessel will be at the risk of the buyer immediately upon the fall of the hammer.
IX.. Any part, not exceeding twenty-five per cent., of the purchase-money may be left, in the case of a British buyer. either on mortgage of the vessel or on banker's or other guarantee approved by the Lords Commissioners of the Admiralty;
