8. Any surplus of assets which may remain after the liquidation of the firm should be held by the Government until further direction from me, and you should inform me in due course of the amount so held.

9. You are at liberty to pass any legislation necessary to enable you to carry out these instructions without prior reference to me, but you should report to me as soon as possible the present condition of the firm's affairs and what has been done with its real estate, if any, goodwill, and other permanent assets.

I AM directed by Mr. Secretary Bonar Law to transmit to you the accom- panying copy of a despatch* which has been received from the Deputy to the Governor of the East Africa Protectorate, on the subject of a draft for £1,000 on the London office of the National Bank of India purchased from the Mombasa office of the bank by a German firm now in process of liquidation.

2. Mr. Bonar Law will be glad to receive your views on the proposal made in paragraph 4 of the despatch. I am to observe that it is understood that the firm has a large balance of assets in hand after making allowance for all claims of non-enemy creditors.

REFERRING to your letter of the 26th ultimo enclosing copy of a despatch from the Deputy Governor of the East Africa Protectorate to the Secretary of State for the Colonies, and asking for my views on the proposal made in paragraph 4 of the said despatch, I shall be obliged if you will inform Mr. Bonar Law that the head office of the National Bank of India in this country has not made any return to me, as Custodian, in respect of the draft for £1,000 to which the despatch refers. As the real position is that the head office, but for the War, would have had to meet the draft, a return should be made, and I am writing to the Bank to that effect. With regard to the proposal that the money should be paid over to me and ear- marked to meet the draft, I beg to point out that no power is given me by the Trading with the Enemy Acts to receive a sum of this description, except when payment is ordered to be made by a Judge of the High Court under the provisions of Section 4 of the Trading with the Enemy Amendment Act, 1914.

SIR,

Government House, Zomba, Nyasaland, 17th January, 1916. In continuation of my Confidential despatch of the 19th of July last, and with reference to your Confidential despatch of the 11th of November, I have the honour to transmit a further report by the Controller of the affairs of Messrs. Ludwig Deuss & Company in Nyasaland, in which he deals with the liquidation of claims of creditors of the Company. Mr. Laurence Smith has been fully advised in the sense of your despatch above referred to and previous correspondence, and your instructions will be complied with by him. His report shows that, after satis- fying all British, Allied, or neutral creditors there will be a balance available of about £12,000, of which £9,000 have already been invested in the War Loan.

2. As touching proceedings in the matter of Messrs. Michahelles & Com- pany and the dissolution of Mr. Storey's partnership, I enclose a memorandum by the Attorney-General which explains the arrangements concluded under orders of the High Court. I may add, however, that the sum quoted as ultimately pay- able by Mr. Storey, £41,713, may be varied as the result of further investigations which are proceeding. The payments by Mr. Storey are being invested in the War Loan.

3. In regard to Mr. Hermann Werth, since I wrote my despatch of the 19th of July I have considered it advisable to intern him, as reported in my despatch No. 19 of the 10th instant. § As, however, it seemed desirable in the public interests that his business should continue to be carried on, application was made to the High Court for a controller to be appointed under the provisions of the Trading with the Enemy Ordinance, No. 4 of 1915, and, Mr. Baker, Lands Officer, Blantyre, is now in charge.
