Freudenberg & Co.; confesses that he sees no way out of the difficul- ties, and asks for instructions; inquires whether it would be prac ticable to advertise in England the intention to sell the more important properties and to invite tenders for them; sale locally would mean prac- tical confiscation.

that private estates may be sold; proposes to save liability of liqui- dated firms under disclaimed con- tracts; deprecates provision that after liquidation no action may be brought against liquidated firms.
Refers to the Report of the Interde- partmental Committee; calls atten- tion to certain differences in the policy recommended in the Report and that laid down by the Trading with the Enemy (Amendment) Act, 1918, and requests more definite information as to the policy the Board of Trade intend to pursue in regard to the pointe specified.
States that the question of liquidation only affects the firm of Freudenberg & Co., and transmite copies of letters from the controllers of the firm showing the nature of the business carried on, from-the Collector of Customs as to the practice of his department in regard to goods con- taining material of enemy origin, and from the Chamber of Commerce on the question of the winding-up of enemy firms

Transmits copy of a note from Swiss Minister requesting that the order for the sale by auction of certain buildings in Penang, belonging partly to Sturzenegger & Company may be withdrawn.
Explains difficulties which have arisen in connexion with the proposed liquidation of Messrs. Freudenberg & Co., and other firms in Ceylon, and requeste assistance in arriving at a decision in the matter.
(Rec. May 1) Inquires, with reference to No. 22, whether it would not be desirable to make no distinction between estates and similar properties of a firm with several partners, and those of either a private individual or a firm with only one partner.
Agrees, in reply to No. 29, that trade marks and goodwill should not be sold, and withdraws proposal that no action may be brought against liqui- dated firms; Secretary of State does not understand proposal to save liability of liquidated firms under disclaimed contracts; assumes that real property and shares in public companies will be sold subject to rights of secured creditora.
