Judge: the full court of the Supreme Court is to be constituted of the two Judges of the Court and the Judge of the Kingston Court.

The appointment and tenure of office of the Judge of the Kingston Court is exactly similar to that of the two Judges of the Supreme Court.

The Governor of Jamaica has power to appoint a Judge to preside over the Grand Court of the Cayman Islands, but in the absence of any such appointment the Commissioner of the Cayman Islands is vested with the powers and jurisdiction of Judge.

According to the Civil Establishment List in the Jamaica Handbook for 1914, the present Commissioner-also appointed by the Governor of Jamaica combines the offices of Commissioner and Judge of the Grand Court.

There are no provisions in the laws referred to above as to the tenure of office of either the Commissioner or Judge, but it is probable that such appointments would be made under the general clause in the Jamaica Letters Patent dealing with the appointment of Judges and other officera, i.e., to hold the same during His Majesty's pleasure (unless provided by law).

Provision is made in the Turks and Caicos Supreme Court Ordinance for | Turks, 503,

B. 6. the appointment of a Judge by Letters Patent under the Public Seal of the Island of Jamaica, issued by the Governor-in-Chief in pursuance of instructions received through one of His Majesty's principal Secretaries of State, but this post has been filled since 1909 by the present Com- missioner of the Islands with the title of Acting Judge of the Supreme Court.

There is nothing in any local legislation as to the tenure of office of either the Commissioner or the Judge, but it was laid down in the Imperial Act providing for the annexation of the Turks and Caicos Islands to Jamaica that the former should be taken and deemed to be part of the said Colony of Jamaica for all purposes whatever." It is probable, therefore, that these appointments are made under the general clause in the Jamaica Letters Patent dealing with the appoint- ment of judges and other officers, i.e., to hold the same during Hig Majesty's pleasure (unless otherwise provided by law).

The legislative provisions now in force are to be found in the Admini- 4/01, s. 3.

stration of Justice Ordinance, 1901, which enacts that the Chief Justice is to be nominated by the Secretary of State and appointed by the Governor under the Public Seal of the Colony and is to hold office during good behaviour, with the proviso that whenever the office of Chief Justice is vacant (or if the Chief Justice become incapable or be suspended or be absent from the Colony) the Governor may do and execute (or may appoint some officer to do and execute) all things that belong to the office of Chief Justice.

At the present time the office of Chief Justice is held by the Governor
