The Chief Court is entitled "The Court of the Resident" and consists
of the Resident. (An O. in C. of 1906 provided for the method of appointment and tenure of office of the Resident, but it is revoked by a later O. in C. which refers to an Agreement of 3rd December, 1905, in which provision has been made for the reception by His Highness the Sultan of a British officer, to be styled the Resident, but neither the O. in C., the Agreement, nor the Courts Enactment contain provisions as to the present method of appointment and tenure of office of the Resident.) There is no reference in the Courts Enactment to judges other than those of the Supreme Court of the Straits Settlements, which has certain original criminal jurisdiction and civil appellate jurisdiction in the State.
(There are also Subordinate Courts of Magistrates, Native Magistrates and Kathis. Magistrates are appointed, and can be suspended, by the Resident; and Kathis are appointed, and can be suspended, by the Sultan in Council subject to "countersiguing" by the Resident.)
The Supreme Court comprises the Court of a Judicial Commissioner (consisting of a Judicial Commissioner) and the Court of Appeal (consisting of two or more Judicial Commissioners and of which the Chief Judicial Commissioner is to be President).
The Chief Judicial Commissioner and Judicial Commissioners are appointed by the Resident-General, with the approval of the High Commissioner, but nothing is stated in the Courts Enactment as to their tenure of office (unless it is held that s. 8 (v), which reads "The Resident may cancel any appointment made by him under this Enact- ment," is in point).

The "Courts" Enactment refers to a Hakim (Judge), to a Naib Hakim (Deputy Judge), and to Ahli Mashuarat (Legal Advisers), but does not give any particulars as to the method of their appointment or tenure of their office.
