Government House, Uganda, 29th April, 1913. WITH reference to your despatch, No. 34, of the 20th January, 1913,* I have the honour to transmit two authenticated and twelve printed copies of the Game Ordinance, 1913, which was duly enacted as No. 7 of 1913, and published in the Gazette of the 15th April last. The Attorney-General's report is also enclosed.

2. On reviewing the revised draft submitted under cover of Mr. Wallis's despatch, No. 483, of the 29th November, 1912,† I noted that the licence fee for the second elephant had been fixed at Rs. 150, owing to a misunderstanding. My original intention was that Rs. 300 should be charged for the second elephant, or Rs. 450 for two, as in East Africa; and, as I consider this the proper pro- cedure to be followed, the Ordinance enacted has been amended accordingly, and I trust that my action will meet with your approval.

Having taken into consideration the request of the Nyassa Company, founded on the necessity for restricting the hunting of big game and of protecting the most valuable species;

I hereby decree, at the instance of the Minister of the Colonies and on the advice of the Colonial Council, and in the terms of Article 24 of the Organic Charter of the 26th of September, 1891, as follows:-

Article I. The following alteration is approved in Article 20 of the Game Regulations for the territory under the administration of the Nyassa Company, sanctioned by Decree, with force of law, of the 6th of September, 1906-

Article 20. The price of a special licence to persons residing in the territory, exclusive of fees and stamps, is Rs. 175 for six months, and Rs. 250 for a year; and Rs. 160 per month to those visiting the country for the sole purpose of hunting.

§ 1. The maximum number of elephants which the holder of a special licence is allowed to kill is five, and as soon as that number has been attained the licence will be considered as having expired; at the termination of the period for which the licence has been granted hunting shall cease, even if the prescribed number of elephants has not been killed.

§ 2. Persons making a stay of at least six consecutive months previous to the date of their application will be considered as residing in the territory. § 3. Any hunter who has killed five elephants and continues to hunt that species without providing himself with a fresh licence will be liable to the maximum fine provided by § 2 of Article 17 of the said regulations.

§ 4. The special licence includes the privileges of hunting specified in Form A.

Article II. Legislation to the contrary is hereby revoked.

The Minister of the Colonies shall accordingly carry this Decree into effect Seat of the Government of the Republic this 2nd day of May, 1913.

THE GAME ORDINANCE, 1913.

Enacted by the Governor of the Uganda Protectorate.

I. This Ordinance may be cited as "The Game Ordinance, 1913." II. In this Ordinance" The Protectorate means the Uganda Protectorate.

"Hunt, kill or capture means hunting, killing or capturing by any method, and includes every attempt to kill or capture, provided always that any animals which are killed or captured shall be counted on a licence and that any person duly licensed may hunt, kill or capture permitted animals until the number of killed or captured animals shall amount to the number permitted by such licence.

Hunting" includes molesting.

Animal " save as herein expressly provided means mammals, and birds other than domesticated, but does not include reptiles, amphibia, fishes, and invertebrate animals.

"} Game means any animal included in any of the Schedules.

Native "

means any native of Africa not being of American or European parentage. Resident means a non-native who has satisfied the Provincial Commis- sioner or District Commissioner of the Province in which he resides that he is a bond fide resident in the Protectorate.

Visitor 11

means a person who visits the Protectorate wholly or partly for sporting purposes not being a public officer or a resident or a native. District Commissioner means the Principal Civil Officer in charge of a

district in the Protectorate.
