10. All proceedings for recovering Fines under and enforcing the provisions of this Ordinance (other than of section 12) may be taken before and be heard and determined by the Magistrate of any District of this Colony, and shall be according to any law for the time being in force regulating the procedure before Magistrates or Justices.

Provided that if the Magistrate before whom any such proceedings are taken and heard is of opinion that the person instituting the same might, with equal con- venience to himself and greater convenience to the Defendant, have instituted such proceedings before the Magistrate of some other district in the Colony, he shall deprive such person of all costs if successful, and shall order him if unsuccessful to pay to the Defendant (either in addition to any other costs, to which he may be legally entitled, or not) and to each material and necessary witness such a sum as may in the opinion of such Magistrate fully compensate him or them for his or their loss of time and necessary expenses incurred in attending before such presiding. 11. All Fines when recovered shall be paid into the Treasury for the public uses of this Colony and the Governor may award to any person who may inform or sue for the same such portion thereof as he sees fit.

12. Every person who shall forge or counterfeit any licence required by this licence,&c., Ordinance or who shall knowingly use any forged licence shall be guilty of an indictable misdemeanour and shall be liable on conviction to be imprisoned with or without hard labour for any term not exceeding twelve calendar months.
