Rules.
1. IF any prize captured by a ship of war of either of the Helligerent Powers shall lic brought by the captors within Her Majesty's jurisdiction, nofice shall be given to the captors immediately to depart and to remove such prize out of Her Majesty's jurisdiction. except in the cases in which provision is made to the contrary by any of the following rules.
2. Every captured merchant-ship remaining in the possessión, or under the control of the captors, or of a prize-crew put on board by them, which has never been condemned by a competent Prize Court, nor brought intra præsidia of the captor's territory, shall be deemed to be a prize within the meaning of these rules, unless she has been actually and bond fide converted into, and used as, a public ship of war.
3. Goods captured, remaining in the possession or under the control of the captor- uncondemned by any competent Prize Court, and brought by the captors, either on board a captured vessel or otherwise, within Her Majesty's jurisdiction, shall be deemed to lu prize within the meaning of these rules. But articles which may have formed part of any captured goods, if brought within British jurisdiction, not by armed ships or privateers of either belligerent, but by other persons who may have acquired or may claim property in them by reason of any dealings with the captors, are not to be deemed prize within the st rules.
4. If any prize shall be brought within Her Majesty's jurisdiction through mere stress of weather, or necessity arising from accidental causes (other than want of repairs, or of coals or provisions, such time as the Governor may think reasonable, under the circumstances, may be allowed to the captors to remove such prize beyond Her Majesty's jurisdiction.
5. If any prize shall not be duly removed beyond Her Majesty's jurisdiction atter notice given for that purpose, or after any time allowed shall have expired, the Governor may detain such prize until Her Majesty's pleasure shall be made known concerning the same, if, in his discretion, he shall see fit to do so.
6. If any such prize shall have been captured by any violation of the territory or territorial waters of Her Majesty, the Governor may, if he shall have sufficient eviden thereof, detain such prize, until Her Majesty's pleasure -hall be made known concerning the same.
7. These Rules are for the guidance of the Executive authority, and are not intended to interfere in any way with proceedings before any Court of Justice. If, therefore, any proceeding should be instituted in any Court of Justice concerning any property alleged to be prize, or to have been taken as prize all orders, which may be made by such Court concerning the same are to be olayed-and executed, in the same manner as if thes Instructions had not been given.
