give the right to hunt any of the animals § 3. Licences of the "first class " mentioned in § 2 of Article 3, with the exception of those the pursuit of which has been prohibited according to the terms of Article 4.

second class " give the right to hunt elephants, §4. Licences of the rhinoceros, buffaloes, zebras, hippopotami, clands, kudus, and any other animals which Governors of districts may think proper to include in the above list according to the terms of Article 39.

Article 42. The fees for special licences are as follows:-

§. The Governor-General of the province may each year alter the fees for licences either in the case of ordinary or special hunting, in conformity with the fees established in the neighbouring countries, and having in view any other circumstances which should Le taken into consideration.

Article 43. The holders of licences for mine prospecting who may apply for an ordinary game licence shall only pay the difference between the fee for the latter licence and the fee paid on the mining licence.

Article 44. The departments charged with the issue of game licences shall file the counterfoils of the licences granted. A special register of licences shall also be kept in the said departments in which shall be entered all occurrences which have taken place with regard to each licence, fines imposed on the holders, &c.

$. A statement shall be made out monthly and forwarded to the Government Secretariat of the district concerned of the counterfoils and register, which shall be accompanied by advice of the amounts collected as fees on licences, fines, and any other receipts.

CHAPTER IV. Supervision.

Article 45. The following officials and persons shall be responsible for super- vision and police control to ensure the proper observance of the provisions of these regulations:-

(a) Administrators of townships or areas, intendentes, residents, chiefs of fiscal posts, commandantes of native soldiers, the civil police, munici- pai inspectors, and officials of the Zambezia Company;

(b) Game commissions;

(c) Commanders of gun launches;

Agents of the authorities, whether permanent or acting, in Crown lands; (e) Customs officials;

(f) Railway stationmasters and employés.

§. Railway stationmasters and employés have the right to confiscate all game in transit or produced for despatch on the railway which has been killed or captured in contravention of these regulations.

Article 46. In case of a violation of these regulations, suspected or notified, the authorities mentioned in the preceding article may, on observing the proper legal formalities, search the dwellings, and examine the parcels or luggage, of the alleged offender. And on the produce of animals being found, which appear to have been acquired in contravention of these regulations, they shall be confiscated, and a statement of the fact shall be drawn up for the purpose of legal proceedings.

Article 47. Customs officials, administrative officers on Crown lands, heads of military posts, commandantes of native soldiers, police sergeants and men, muni- cipal inspectors and stationmasters and employés, as well as any persons reporting violations of these regulations, shall be entitled to one-third of the fine which, through their intervention or notification, shall have been imposed.

Article 48. The Governor-General of the province may adopt any other general or special measure for each district, which he may deem necessary for strict super- vision and police control over hunting.

CHAPTER V.

Penalties.

Article 49. Beside the penalties to which persons engaged in hunting are subject in accordance with the provisions of the general laws, they shall be liable to the following:-

(1) Cancellation of the game licence. (2) Fines.

(3) Seizure and confiscation of arms and of the animals killed or captured. Article 50. The cancellation of a licence will take place in the cases provided for in Article 27, or when the holder thereof has committed three transgressions punishable under these regulations. Besides the loss of the licence, and the pay- ment of the fine imposed, the person on whom the above penalty has been inflicted shall be disqualified to obtain another licence during the space of five years in the whole province.

The penalty of a fine shall be imposed in the cases provided for by Articles 5,

6, 7, 8, 11, 12, 13, 14, 15, 17, 19, 23, 24, 34, 39, and 40.

The penalty of seizure and confiscation of arms, and of the produce shall be applied in the same cases as the fines, and concurrently therewith.

§1. Whenever the offender has not sufficient available means for the pay- ment of the fine which may be imposed on him, the fine shall be replaced by imprison- ment at the rate of 1,000 to 5,000 (reis) per day.

§ 2. The penalty of imprisonment imposed by virtue of these regula- tions shall never exceed one year.

§3. In the case of offences committed by natives, the fines shall be re- placed by unpaid labour on Government or municipal works for a period of from three to twelve months.

§ 4. The fines definitely fixed by these regulations may be imposed by any of the officials and persons mentioned in Article 29 pursuant to the statement of facts which may have been drawn up.

§ 5. Fines where the amounts vary shall only be imposed by the Governor of the district, pursuant to a statement of facts, or of a report by any of the officials or persons referred to in the preceding sub-article.

§ 6. The Governor of the district shall adjust the penalties of fines or imprisonment, within the limits fixed in the article which has been infringed, se

as to correspond with the gravity of the offence, the results to which it may give rise, and the aggravating or attenuating circumstances attached thereto.

§ 7. In the case of repetition of offences, the penalty will always be greater, and the fines or imprisonment may be increased to three times the amount fixed in these regulations.

Article 51. Foreigners applying for game licences to hunt in the territory of the province shall offer a reliable surety, who shall be responsible for the payment of any fines which may be imposed on them, without which the licence will not be granted.

§. Any person not a resident in the province found hunting without a licence shall be at once arrested, and will not be released until the amount of the proper fine has been paid.

Article 52. As soon as the amount of the fine has been fixed by the proper authority, the offender will be summoned to pay it within eight days, counted from the date of the summons.

§1. The payment may be made direct to the official charged with the summons in exchange for a proper receipt.
