LAW OFFICERS TO COLONIAL OFFICE.

[Conduct of the inhabitants of British Protectorates during hostilities between Foreign Stutes-Draft Order in Council.]

Royal Courts of Justice,

12th August, 1904.

WE were honoured by your commands signified to us by Mr. Bertram Cox in his letter of the 20th July last stating that he was directed by you to request us to take into our consideration the draft of an Order in Council which you proposed to submit to the King with a view to providing for the regulation of the conduct of the inhabitants of British Protectorates and other persons residing therein during the existence of hostilities between foreign states with which His Majesty was at peace.

That he was to enclose for our information a copy of a letter received in reply to one in which the Secretary of State for Foreign Affairs was furnished with a copy of the draft Order for his observations, and to state, with reference to our report dated the 19th of March 1904* as to the procedure necessary for rendering the Foreign_Enlistment Act operative in certain British Possessions, that the enclosed draft Order in Council has been prepared with the concurrence of the Foreign Office, with a view to extending the pro- visions of that Act with as little alteration as possible to the British Protectorates, with the exception of Cyprus, in which case it was intended that the Order in Council of the 18th of May 1881 should remain in force.

That he was to request that you might be favoured with our report as to whether! the terms of the draft Order were suitable and sufficient for its purpose, or in what

particulars, if any, we would advise that they should be modified,
