That Sir Philip Currie was to request that we would take the papers transmitted with his letter into our consideration, and that we would favour your Lordship with our opinion whether, having regard to all the circumstances of the case, Her Majesty's Government were justified in formally calling upon the Venezuelan Government to make pecuniary compensation to Campbell's surviving relatives, and also with any general observations we might have to offer on the subject.

That having regard to all the circumstances of the case, we are not of opinion that Her Majesty's Government would be justified "in" formally calling upon the Venezuelan Government to pay compensation.

LAW OFFICERS to COLONIAL OFFICE. MY LORD,
Royal Courts of Justice, September 18, 1891. We were honoured with your Lordship's commands signified in Mr. J. Bramston's letter of the 6th August ultimo, stating that he was directed to transmit to us, for our consideration, a copy of a letter which had been addressed to Sir W. Whiteway, the Premier of Newfoundland, who had recently left this country, together with a copy of a Draft Bill to which that letter related.
That that Bill met the strong objection felt by the Colonists to the Naval Officers taking action at their sole discretion, and not under the judgment of a court, and at the same time it afforded protection to those officers in the execution of their duties, as, after the Bill had been passed by the Colonial Legislature, they would, before taking any action, obtain the order of a Court of Judicial Commissioners specially created for the purpose.
That that draft, which was prepared by the Parliamentary Counsel, had been approved by the Marquis of Salisbury, and Mr. John Bramston was to request that we would be good enough to favour your Lordship with any observations that we might wish to make
upon it.

We have varied the form of sub-section (3) of section 5 and noted a clerical error in section 6.
