LAW OFFICERS to BOARD OF TRADE.
OPINION.
Royal Courts of Justice,
March 4, 1891.
We have examined the Newfoundland Copyright Act. 1890, and, being of opinion that its provisions ought to be construed as to works first published in Newfoundland, we think that Her Majesty's assent need not be withheld, but that the Act may be permitted to come into operation.
It should, however, be pointed out to the Newfoundland authorities that, if section 5 should be judicially interpreted to include works other than those first printed and published in Newfoundland, the Act would be inconsistent with the Imperial Statutes, and further legislation would be necessary.
