MY LORD,
We were honoured with your Lordship's commands, signified in Mr. Wingfield's
Royal Courts of Justice, February 25, 1890. letter of the 4th instant, stating that he was directed by your Lordship to transmit for our consideration the under-mentioned documents, viz. :—
A copy of the Act 25 Victoria, chapter 20, of the Legislature of the Bahamas relating to superannuation allowances to officers retiring from the public service of the Colony.
A copy of the Act 29 Victoria, chapter 14, amending the said Act of 1862.
A copy of an Act 32 Victoria, chapter 12, further amending the law on the same subject.
A copy of an Act 52 Victoria, chapter 27, to consolidate and amend the various laws relating to the civil and judicial establishments of the Colony, which repealed the last-mentioned Act.
A copy of a despatch from the Secretary of State to the Governor of the Bahamas commenting on the intention and present application of the law relating to super- annuation allowances, with copy of the Act 46 Victoria. chapter 11, referred to therein. And a copy of a despatch in reply from the Governor of the Bahamas, transmitting a report from the Attorney-General of the Colony upon the questions raised.
That Mr. Wingfield was to request that we would furnish your Lordship with our opinion as to the proper construction of section 28 of the Act 32 Victoria, chapter 13. and of section 28 of the Act 52 Victoria, chapter 27, in relation to the questions raised in your Lordship's despatch of the 7th December last.
We have taken the matter into our consideration, and, in obedience to your Lordship's commands, have the honour to-

That, in our opinon, the effect of the Act of 1869 was that no person appointed after the commencement of that Act had any claim to superannuation, and the 28th section of the Act 52 Victoria, chapter 27, re-enacts that provision, with the unimportant difference that the date before which an officer must have been appointed in order that he should have claim to superannuation is now the 14th of April 1869 instead of the 1st of June 1869.
