(CAPE OF GOOD HOPE.)

LAW OFFICERS to COLONIAL OFFICE.

Royal Courts of Justice,

April 30, 1887.

We were honoured with Mr. Bramston's letter of the 19th instant, stating that he was directed by you to transmit, for our consideration, a copy of a letter from Mr. Upington, Attorney-General of the Cape Colony, at present in this country, on the subject of the Colonial Attornies Relief Acts, and to state that it appeared unnecessary to trouble us with the enclosures to that letter.

That it would be seen that attornies admitted in the superior courts in England were admitted in the Colony on mere proof of authority to practise in England.

That Mr. Bramston was, however, to ask whether, in our opinion, the facts stated in paragraph 6 of Mr. Upington's letter constituted any obstacle to the extension of the Acts to the Colony, having regard to the terms of the Colonial Attornies Relief Act Amendment Act, 1884.

That Mr. Bramston was also to inquire whether, in our opinion, in the circumstances mentioned in paragraphs 7-10 of the letter, the system of jurisprudence in the Cape Colony might be taken to be sufficiently assimilated to the common law and principles of equity, as administered in England, to justify the extension of the Acts to the Colony, upon completion of the formalities required by them.

In compliance with the request contained in Mr. Bramston's letter, we have the honour to

Report

1. That in our opinion, the facts stated in paragraph 6 of Mr. Upington's letter do

not constitute any obstacle to the extension of the Acts to the Colony.

2. That in the circumstances mentioned in paragraphs 7-10 of the letter, the system of jurisprudence in the Cape Colony may be taken to be sufficiently assimilated to the common law and principles of equity, as administered in England, to justify the extension of the Acts to the Colony.

We have, &c.,

(Signed)
