LAW OFFICERS to COLONIAL OFFICE.

We were honoured with Mr. Bramston's letter of the 3rd ultimo, stating that

-Temple, 12th August 1879. he was directed by the Secretary of State for the Colonies to transmit to us the accompanying draft of an Order of Her Majesty in Council to amend the Western Pacific Order in Council, and he was to request that we would inform you whether we were of opinion that the draft might be submitted for Her Majesty's approval.

That with reference to clause 10 Mr. Bramston was to enclose a copy of two letters from the Foreign Office and an extract of a letter from Sir A. Gordon, and to state F.0.17 April that you accepted the reasoning of the High Commissioner, and had caused that F.0., 25 June clause to be prepared, as it appeared to you to be preferable to confer those special Extract from powers for exceptional cases than to risk a failure of justice in the cases of extreme page 8 to page gravity to which Sir A. Gordon referred. That Mr. Bramston was at the same time to remind us that the Governors of Labuan, St. Helena, and the Falkland Islands, who were often laymen, had the power of trying capital cases.

That Mr. Bramston was to request to be favoured with an early reply to that reference, as it was desirable that the Order in Council upon the subject should be transmitted to the High Commissioner as soon as possible.

In compliance with the request contained in Mr. Bramston's letter we have the honour to

That in view of the exceptional circumstances pointed out in the extract from

Sir A. Gordon's letter we think clause 10 may be justified, and we are of opinion that

the draft of the Order may properly be submitted for Her Majesty's approval.
