SIR,
No. 203,
(WESTERN AUStralia.)
LAW OFFICERS to COLONIAL OFFICE.
WE were favoured with Mr. Bramston's letter of the 19th ultimo, stating that he
Temple, 28th May 1879. was directed by the Secretary of State for the Colonies to transmit to us a copy of a despatch from the Governor of Western Australia requesting instructions as to the No. 13, proper form of oath to be taken by a member on his appointment to the Legislative 22 January Council of that Colony.
That Mr. Bramston was also to enclose a copy of a circular despatch which was addressed to the Governors of all the Colonies, on the subject of oaths, upon the 8th of May 1869, and Mr. Bramston was to request that we would favour you with our opinion upon the question raised in the Governor's despatch.
In compliance with the request contained in Mr. Bramston's letter we have the
honour to
Report
That by the 13th and 14th Vict. cap. 59. sec. 12. the provisions of the 5th and 6th Vict. cap. 76. are applied to Western Australia, and we are of opinion that the oath contemplated by the 25th section of that Act must be regarded as that which governs the matter. We do not think that the legislation referred to in Lord Granville's circular affects the Colonies.
The Right Hon.
We have, &c., (Signed) JOHN HOLKER.
