SOLICITOR-GENERAL to FOREIGN OFFICE.
I AM honoured with your Lordship's commands, signified in Sir Julian
Temple, September 10, 1878. Pauncefote's letter of the 9th instant, stating that he was directed by your Lordship to transmit to me the draft of an Order in Council constituting the office of High Com- missioner and Commander-in-Chief over the Island of Cyprus, and making provision for the government of that Island; and also the drafts of a commission and instruc- tions under the Royal Sign Manual and Signet, the former appointing Lieutenant- General Sir Garnet Wolseley, G.C.M.G., K.O.B., to be Her Majesty's High Com- missioner, and the latter regulating the exercises of the powers and authorities conferred upon that office; and that the above drafts are accompanied by an explanatory memorandum and with copies of the documents therein referred to and noted in the margin. Sir Julian Pauncefote also requested that we would take these papers into our consideration, and favour your Lordship at our earliest convenience with our opinion as to whether the drafts of the proposed Order in Council, Royal Commission, and Instructions, are sufficient in law to carry out the objects indicated in the memorandum and may properly be laid before the Queen for Her Majesty's approval.

That, inasmuch as the urgency of the matter prevents any opportunity of commu- nicating with the Attorney-General and Dr. Deane, I have the honour to report my own opinion that the drafts of the proposed Order in Council, Royal Commission, and Instructions are sufficient in law to carry out the objects indicated in the memorandum, and may properly be laid before the Queen for Her Majesty's approval; but I would suggest for your Lordship's consideration whether the provision at the end of paragraph 6 of the draft Order in Council, that the unofficial members of the Legis- lative Council shall be natives of the Island, is appropriate to the peculiar circumstances of the Island of Cyprus.
