MY LORD,
No. 820.
(GOLD COAST.)
LAW OFFICERS to COLONIAL OFFICE.
We are honoured with your Lordship's command, signified in Mr. Holland's
Temple, May 20, 1873. letter of the 17th instant, stating that with reference to our report of the 15th instant,* in which we stated that Her Majesty's Government could not take any steps to stop the importation by British subjects or in British vessels of arms and ammunition into Assinee or other port outside the limits of Her Majesty's Settlement in the Gold Coast, he (Mr. Holland) was desired by your Lordship to direct our attention to the 150th section of the Customs Consolidation Act (16 & 17 Victrc. 107.) under which Her Majesty is empowered by Proclamation or Order in Council to prohibit the export of arms, ammunition, and gunpowder, und he (Mr. Holland) was to request us to favour your Lordship with our opinion whether, under the provisions of that section, the Queen had power by Proclamation or Order in Council to prohibit the exportation of arms, &c. for any particular ports or places as, for example ports on the west coast of Africa or any particular port or ports on that coast.
In obedience to your Lordship's commands we have the honour to
Report
That in our opinion the power of the Crown to prohibit the export of arms, ammu- nition, gunpowder, and other articles under 16 & 17 Vict. c. 107. s. 150. is limited to those cases in which the exportation is altogether forbidden.
The Right Hon. the Earl of Kimberley,
