We are of opinion that the difficulty occasioned by Instruction 28 would be disposed of (as your Lordship suggests) by its repeal, as on and from the 1st of June last.

We see no objection to the selection of a bishop in the manner proposed by section 1, or to the right and mode of appeals in section 5.

And we are of opinion that the Act is in other respects proper to receive Her Majesty's sanction.

LORD GRANVILLE to MR. PERCY FFRENCH.

Foreign Office, August 1, 1872. It appears from Mr. Layard's Despatch No. 272 of the 3rd ultimo, respecting the case of the "Vigilant," that the Spanish authorities have had before them the depositions which were taken on board that vessel by the Spanish Consul.

But as the officers and men in the "Vigilant's" bost had no opportunity of being heard in their defence, or of cross-examining the Spaniards who charged them with gross misconduct, for which, if guilty, they ought to be punished, I have to instruct you to request the Spanish Government to hold a new inquiry, at which the British subjects whose conduct is impugned may be present, in order that the truth as to their proceedings may be thoroughly sifted.
