11759.

SIR,

No. 738.

(MALTA.)

FOREIGN OFFICE to COLONIAL OFFICE.

Foreign Office, November 30, 1871. I AM directed by Earl Granville to request that you will inform the Earl of Kimberley that his Lordship caused to be referred to the Law Officers of the Crown your letter of the 21st instant, suggesting that the Governor of Malta should be authorised to introduce a local enactment extending to that Colony the provisions of the 24th section of the Extradition Act of 1870.

In requesting the opinion of the Law Officers upon this subject they were informed that at present no treaty under the above Act has been concluded with Italy, although one is under consideration; and they have now reported that the proposal of the Crown Advocate of Malta to introduce a local Act, as above referred to, may, in their opinion, be properly approved.

The Under Secretary of State,

Colonial Office.

I am, &c.

(Signed) E. HAMMOND.
