Senior Staff means all postal officers of and above the rank of Superin- tendent and includes all European officers.
2. The territories of the Colony of the Straits Settlements and of the Federated Malay States shall form one single postal area to be styled Malaya which shall adhere by that style to the Universal Postal Union.
3. The postal departments of the Administrations shall be placed under the control of a Board in the manner hereinafter provided.
4. There shall be constituted a Board to be styled the Malayan Postal Board which shall consist of the Chairman, of one representative of each Administration, and of two official and two unofficial members to be appointed by the High Commissioner.
5. The Chairman of the Board shall be styled Director-General of Posts and Telegraphs, Malaya. The substantive holder of the post shall be appointed by the Secretary of State for the Colonies on the recommendation of the High Commissioner.

6. Each Administration, including each State of the Federated Malay States, reserves the right to its own distinctive issue of stamps, provided that the word Malaya shall appear in Roman characters on all stamps issued for postal purposes. 7. Each Administration shall delegate and entrust to the Board the direction of the Postal Department in its territory subject to such limitations as are set out in this Agreement.
8. The Postal Department of each Administration shall prepare the annual estimates of postal revenue and expenditure, including any supplementary estimates which may be found necessary. Such estimates shall be approved by the Board before being submitted to the Government concerned.
9. The Postal Department of each Administration shall collect the postal revenue and disburse the postal expenditure in accordance with the estimates passed by the Government concerned, provided that the provision for expenditure may in any case be reallocated by the Board between the authorized heads of expenditure. Board shall inform the Administration of any such reallocation.

10. The expenditure of the Headquarters organization of the Board shall be submitted for the approval of the High Commissioner.
11. Each Administration undertakes to contribute to the cost of the Headquarters organization of the Board in proportion to its postal revenue.
12. The Departmental duties and responsibilities of the Senior Staff in each Administration shall be defined by the Board.
13. All postal officers shall be subject to the General or Standing Orders of the Administration in which they are serving.
14. Appointments, promotions, and changes in the Postal Staff other than the Senior Staff shall remain under the control of each Administration.
15. Appointments, promotions, and changes in the Senior Staff shall be dealt with by the Board and submitted for confirmation to each Administration, or in the case of a Headquarters appointment to the High Commissioner.
16. Each Administration undertakes to pay its ascertained share of such pensions and gratuities as may from time to time be payable in accordance with law to postal officers in respect of service in the Postal Department in such Administration.
17. Each Administration shall retain the ownership of all postal buildings, apparatus, and appliances situated within its territory and of all additional postal buildings, apparatus, and appliances which may from time to time be so erected or installed at the expense of such Administration.
18. All purchases and repairs for or on behalf of any Administration shall be made through the Union Stores and Workshops, separate accounts being kept for each
Administration.
19. Each Administration undertakes to entrust to the Board control over all international agreements and accounts, and authorizes the Board to enter into any such agreement on its behalf.
20. Each Administration undertakes to accept such apportionments of revenue and expenditure between the various Administrations concerned as may be determined by the Board.
21. Each Administration agrees to take steps to secure that the system of postal law and rules thereunder shall as far as reasonably possible be uniform throughout Malaya.
22. Nothing in this Agreement shall invalidate any conventions or agreements entered into by the Postal Department in any Administration prior to this Agreement. 23. Each Administration undertakes to make any changes in its legislation which are necessary to give effect to this Agreement.

24. In the event of any dispute or difficulty arising between any Administration and the Board in connexion with this Agreement each Administration undertakes to accept the decision of the High Commissioner.
25. Any Malay State under British protection which may apply for membership of the Postal Union shall be admitted to membership thereof upon signing a form of adherence. From the date of the signing of such form, or from such other date as may therein be specified, the territory of such State shall be included within the postal area of Malaya and the Administration of such State shall comply with all the under- takings in this Agreement contained to the same extent and in the same manner as the signatories hereto.

WHEREAS by an Agreement dated the
and made between the Governor of the Straits Settlements, for and on behalf of His Britannic Majesty in His Government of that Colony, and the Rulers of the Federated Malay States of Perak, Selangor, Negri Sembilan, and Pahang the signatories thereto constituted themselves a Postal Union under the style of Malaya, and have under such style adhered to the Universal Postal Union.
And whereas Clause 25 of the said Agreement provides for the entry into the said Union of any Malay State under British Protection which desires to enter into and adhere to the said Union.

WITH reference to your letter of the 20th April, transmitting a copy of a
30th June, 1932. despatch with enclosures from the High Commissioner, Federated Malay States, I am directed by the Postmaster-General to say, for the information of the Secretary of State for the Colonies, that there would not appear to be any objection under the Postal Union Convention to the formation of the proposed Malaya Postal Union which would join the Universal Postal Union as a single unit, nor to the adoption of the proposed Malayan postage stamps; but I am to offer the following observations regarding certain financial results which may be anticipated if the proposal is adopted in its present form:-
1. At present, each of the separate postal organizations concerned, viz., Straits Settlements, Federated Malay States, Johore, Kelantan, Kedah (including Perlis), Trengganu, and Brunei, forms a separate unit of the Universal Postal Union; and letter mails or correspondence à découvert sent in transit through them give rise to the payment of appropriate transit rates to each unit taking part in the transmission. But the adoption of the proposal would entail the substitution for international accounting purposes of one Administration, i.e., Malaya, for the present individual units; and it follows that no part of Malaya would be able to claim transit payment in respect of letter mails or correspondence à découvert passing through its territory to any other part. The charges at present collected by the Straits Settlements Administra- tion on Imperial and foreign mails for the Federated and Unfederated Malay States would lapse, and it is estimated that the loss of revenue to Malaya under this head would amount to approximately 60.000 gold francs per annum.
