MY LORD,

Temple, April 1, 1871. We are honoured with your Lordship's commands signified in Sir Frederic Rogers' letter of the 28th stating that he was directed to transmit to us a copy of a Despatch from the Governor of South Australia forwarding a copy of a Bill passed by the Colonial Legislature entitled " An Act to fix the tenure of office of the primary

judge in equity, and to provide for the performance of the duties of the office of primary judge in equity in certain cases.'

That we would observe the Governor had reserved that Bill at the request of the judges of the Supreme Court who objected to its provisions as affecting the indepen- dence of the judges and the tenure of the judicial office.

And that your Lordship desired him to request that we would take the papers into consideration, and furnish your Lordship with our opinion at our earliest convenience, upon the validity of the objections urged by the judges in the memorial forwarded by the Governor.

In obedience to your Lordship's commands we have taken these papers into con- sideration, and have the honour to
