LAW OFFICERS to FOREIGN OFFICE.

Temple, June 30, 1870. We are honoured with your letter of the 11th instant, stating that, with reference to our report of October 1st last,* respecting the case of the "Telegrafo," you were directed to transmit to us herewith a further letter from the Colonial Office, enclosing a copy of a Despatch from the Governor of the Leeward Islands, reporting that this vessel has been restored by the Vice-Admiralty Court at Tortola, without costs or damages, on the ground that the acts charged were committed within the exclusive jurisdiction of the Republic of San Domingo. That the Consul at San Domingo has, as we should observe, requested an appeal from this decision, under- taking to pay all costs and damages, and you were pleased to request that we would take these papers into our consideration, and furnish you with our opinion as to the proper course to be pursued under the circumstances stated by the local Attorney General. The previous correspondence was also enclosed for convenience of reference.

In obedience to your commands, we have the honour to

Report

That we think the decision of the Vice-Admiralty Court of Tortola sufficiently open to question to justify an appeal, on the Domingan Government undertaking to pay all costs and damages.

The Right Hon. E. Hammond.
