LAW OFFICERS-to COLONIAL OFFICE.

Temple, February 1, 1870. We are honoured with your Lordship's commands, signified to us in Sir Frederic Rogers' letter of the 26th ultimo, stating:—

Ï. That in our report of the 17th November,* upon the question of modifying the addresses of the Parliament of Canada for the admission of the Colony of Newfound- land into the Dominion, so as to ensure the adoption by the Dominion, after union, of the treaty obligations which attached to the Colony of Newfoundland, we suggested certain terms of alteration to effect that purpose.

2. That upon consideration of those terms, it had been questioned whether they might not be somewhat too wide in the obligations which they imposed, or at any rate. might not be so regarded in Canada.

3. That the object, of course, was merely to place Canada after the union in the position which Newfoundland occupied before that event.

4. That your Lordship directed Sir F. R. Sandford to ask our opinion whether that could not be effected by the subjoined words, which might in his judgment, be more acceptable to Canada, viz. :-

"The Dominion of Canada shall, after the union, be in the same position and subject to the same liabilities and obligations as Newfoundland was at the time of such union with respect to any treaty or engagement entered into between Her Majesty and any Foreign Sovereign Government or Power."

That the form of words which your Lordship proposes to substitute for the terms suggested in our report of 17th November last, as likely to be more acceptable to Canada, will, in our opinion, be sufficient for the object which Her Majesty's Govern- ment has in view.
