MY LORD,
Temple, January 8, 1870. We are honoured with your Lordship's commands, signified in Mr. Hammond's letter of the 10th ultimo, stating that with reference to our report of the 9th October he was directed to transmit to us, together with the previous papers, a letter from the Colonial Office containing observations on a memorandum furnished to that department by the Home Office respecting the proposed Hong Kong Ordinance for the extradition of fugitives from justice from Macao, and Mr. Hammond was pleased to request that we would take the same into consideration, and furnish your Lordship with our opinion thereupon.

That we have read with attention the memorandum of Mr. Hugessen and the remarks of Lord Granville thereupon. So far as relates to any matter reported upon by us in the report we had the honour to submit to Lord Granville on the 9th Octo- ber 1869, we see no reason to alter or qualify any opinion therein expressed.
The changes of phraseology suggested by Mr. Hugessen appear to us to be un- necessary, but (if it be thought desirable to alter the mere wording of the Ordinance) to be unobjectionable. Some inaccuracies of reference which he has pointed out ahould be amended. With reference to the important question as to the tribunal, a power which is to decide upon the political or non-political character of the offence as to which extradition is demanded, we agree with the remarks which Lord Granville has made upon it, but we beg leave to repeat what we suggested in our last report that this and some other questions which arise upon the Ordinance, are rather for your Lordship's discretion than for our opinion.
