Temple, November 9, 1869. We are bonoured with your Lordship's commande signified in Mr. Sandford's Admiralty letter of the 5th instant, stating that he was directed by your Lordship to transmit us of, No. 72. for our consideration and report, the accompanying copies of a correspondence on the Go No. 8, subject of an application made by Messrs. Stringer, Pembroke & Co., for the repayment 0.0 August of certain tonnage dues charged on the barque Cyrene," which was chartered to convey 13 October. 414 tons of coal for the Government of Malta.

A copy of Ordinance No. 5 of 1853, under which Messre. Stringer, Pembroke & Co., claimed exemption, was enclosed therewith for convenience of reference.
In obedience to your Lordship's commands we have taken this matter into our con- sideration, and have the honour to

That we are of opinion that the Crown Advocate of Malta has rightly interpreted
the Ordinance No. 5 of 1853, and that the barque "Cyrene" was under the circum-
stances not entitled to be exempted from the payment to tonnage dues.
