MY LORD,

LAW OFFICERS to COLONIAL OFFICE.

Temple, October 5, 1869. We are honoured with your Lordship's commands signified to us in Sir Frederic Rogers' letter of the 25th September last, stating-

1869.

1st. That he was directed by your Lordship to recall our attention to our Report of the 10th June, with reference to the proceedings taken by Dr. Colenso against Mr. Green, the Colonial Chaplain at Natal, and to the question whether Mr. Green should be allowed to continue to hold the office of Colonial Chaplain, and to transmit to us a oopy of a Despatch of the 17th July, with enclosures from the Lieutenant-Governor No. 59, of Natal, stating that the Rev. J. Green had returned to the Colony from leave of 17 July absence, and that the question was thus re-opened, whether the judgment of the Supreme Court of Natal of the 9th January 1868 was sufficient to cause a vacancy in the office held by Mr. Green as chaplain of the English Church in Pietermaritzburg, and to preclude him from receiving a salary as such out of the public funds, and also a copy of a confidential Despatch of the 19th July, with enclosure.

2nd. That Sir F. Rogers was further directed to transmit to us the copy of a De- spatch which your Lordship proposed to transmit to the Lieutenant-Governor of Natal, and to request that we would favour your Lordship with our opinion whether the papers now received contain anything which require the terms of the proposed De- spatch to be qualified.

In obedience to your Lordship's commands, we have the honour to

Report

That we see no objection to the substance of the form of your Lordship's Despatch to Governor Keate.

We think our former Report was correct, and the dispute which has now arisen as to the wording of the judgment of the Supreme Court, and as to the effect of that wording, affords an additional and cogent reason against any interference by the Executive Government, at all events at present.

The Right Hon. Earl Granville, K.G.,
