MY LORD,

Temple, July 5, 1869. I AM honoured with your commands, signified in Sir Frederic Rogers' letter of the 3rd July instant, stating that he was desired by your Lordship to transmit to ne the copy of a telegram sent by the Governor of Gibraltar, in which my opinion was requested upon the question whether certain depositions could be read at å trial now pending in Gibraltar of certain persons for scuttling a ship: and further stating that the alterations in red ink had been made here for the purpose of rendering the telegram more easily intelligible, and that a copy of the Gibraltar Ordinance referred to by the Attorney General was annexed for reference; and further stating that he was desired to add that the vessel alleged to have been scuttled was the British barque came up, and by the Hope," and that as she was being abandoned the “Memnon"

"the second mate and some other seaman direction of the captain of the "Memnon were sent on board the "Hope," and that it was mainly upon the evidence of the captain and mate proceedings were taken against the captain of the "Hope;" and further requesting that I would, at my earliest convenience, favour your Lordship with my opinion as to what answer should be returned to the telegram which I would observe was noted urgent.
