MY LORD,

Temple, July 2, 1869. We are honoured with your Lordship's commands, signified in Sir F. Rogers' letter of this day's date, stating that he was directed to transmit to us a copy of a Report from the Attorney General of the Bahamas in further reference to the case of the "Salvador," from which it appears that the action taken under the 6th section of the Foreign Enlistment Act is, for the present, inoperative, the master, Catlin, having avoided service and quitted the Colony.

That the Attorney General also desires to learn what, in our opinion, is to be the course pursued should the proceedings under the 7th section of the Foreign Enlist- ment Act fail, and whether the Receiver General of the Colony is an officer of customs within the meaning of the Foreign Enlistment Act. The volume containing the laws constituting Mr. Dumaresq's office was also enclosed, and Sir F. Rogers was to request that we would advise your Lordship as to the points raised by Mr. Anderson.

That we are of opinion that in the event of the proceedings under the 7th section of the Foreign Enlistment Act failing, the vessel should be detained as a security for penalties under the 6th section. We are further of opinion that the Receiver General of the Colony is an officer of customs within the meaning of the Foreign Enlistment Act.
