2. We think that an Act of the Imperial Legislature is not essential, but that the wrongful levy of the increased rates might be remedied by local legislation. Such legislation might provide that where duties bave been levied under any Act higher than those prescribed by Schedule C., while in other cases lower duties or no duties have been paid or levied on other goods, the higher payments should be deemed valid and lawful, and the payment of lower duties he deemed lawful and sufficient to exonerate from payment of other duties leviable at the time at which they were paid. and that where no payments have been made by reason, of exemption of articles under Acts of the Legislature no demand or levy should be made in respect of articles exempted for the period during which they were made free of duty.

3rd. This question involves matters of policy rather than law, but it occurs to us that such an alteration as suggested would be inore likely to lead to complication and difficulty than if the Imperial Statute remained in its present state, and in our opinion. therefore, its provisions had better remain altered.

Temple, July 8, 1868. MY LORD,

We are honoured with your Lordship's commands, signified in Mr. Hammond's letter of the 20th June ultimo, stating that he was directed by your Lordship to transmit to us a letter from the Colonial Office, forwarding a correspondence which has taken place between the Siamese Government and the Governor of Singapore relative to the apprehension in that Colony of a Chinaman accused of coining Siamese money, and to request that we would take these papers into our consideration and favour your Lordship with our opinion as to the course that should be pursued in the matter.

In obedience to your Lordship's commands we have taken the papers submitted to us into our consideration, and have the honour to

That we are of opinion that the answer of the Governor of Singapore to the Siamese Minister of Foreign Affairs is correct.

The statute 24 & 25 Viot. c. 99., sections 18 to 24, inclusive may serve as a guide for the legislation proposed by the Governor, though the statute itself not having, we believe, been extended to the Colonies by statute similar to the 16 & 17 Vict. cap. has no operation or effect there. It appears to us right that the defect in the Criminal Law should, as proposed by the Governor, be remedied by legislation in the Colony as soon as possible.
