MY LORD,
Lincoln's Inn, May 19, 1865. We are honoured with your Lordship's commands, signified in Mr. Hammond's letter of the 12th May instant, stating that he was directed by your Lordship to transmit to us a letter from the Colonial Office enclosing a copy of the proceedings taken against the St. Albans raiders before the Recorder of Toronto. A previous letter from the Colonial Office enclosing a copy of Judge Smith's decision in this case was likewise transmitted to us.
Mr. Hammond was also pleased to state that he was directed by your Lordship to request that we would take these papers into consideration, and that in reporting to your Lordship our opinion thereupon we would inform your Lordship whether we consider that the offence with which Lieutenant Young was charged was bailable.
In obedience to your Lordship's commands we have taken these papers into our consideration, and have the honour to

That we are of opinion that the offence with which Lieutenant Young was charged was a bailable offence. The papers laid before us do not appear to call for any obser- vations in addition to those which are contained in our former reports on this subject.
