Doctors' Commons, October 4, 1864. I AM honoured with your Lordship's commands, signified in Mr. Hammond's letter of the 1st instant, stating that he was directed by your Lordship to transmit to me therewith a letter from the Colonial Office, together with its enclosures, requesting your Lordship's opinion as to a demand which has been made by the Italian Govern- ment on the Governor of Malta for the extradition of two Sicilians charged with murder. Mr. Hammond was also pleased to enclose a copy of the Extradition Ordinance referred

to in the accompanying papers, and to request that I would take the same into con- sideration and furnish your Lordship with my opinion thereupon.

In obedience to your Lordship's commands I have taken these papers into considera- tion, and have the honour to

That I agree with the opinion of the Crown Advocate in this case, and I advise your Lordship to return an answer to the Secretary of State for the Colonies, to the effect that the Governor of Malta may lawfully render up these alleged 'criminals to the Italian Government.
