Doctors' Commons, June 16, 1863. I AM honoured with your Lordship's commands, signified in Mr. Hammond's letter of the 13th June instant, stating that he was directed to transmit to me a letter from the Colonial Office, enclosing a copy of a Despatch from the Governor of the Cape of Good Hope, together with the correspondence therein referred to, respecting agreement connected with official matters which had arisen between the Consul and the Vice-Consul of the United States at Cape Town; and to request that I would take this matter into consideration and furnish your Lordship with my opinion thereupon.
In obedience to your Lordship's commands, I have taken this case into consideration, and have the honour to

That the Governor of the Cape of Good Hope appears to have acted discreetly and properly in this matter. That, with respect to the general question put by his Excel- loncy, it must be generally answered by saying that instances may be supposed in which the Executive Government might properly certify to a court of law that a foreign consul had been duly recognised as such, and that he was entitled to whatever privileges or authority belonged to that character, but that it is not easy to foresee any other manner in which the Executive Government could or ought to interfere in proceedings on behalf of, or against, a foreign consul, carried on in a court of law.
