No. 124.
(TASMANIA.)
LAW OFFICERS to TREASURY.
OPINION on the 15th CLAUSE of "The ALIEN Act of TABMANIA, No. 2, of 1861."
Temple, July 16, 1862. We have considered the 15th clause of the proposed Aot of the Legislature of Tasmania to which our attention has been called and we do not see any objection thereto.
The only question that arises is whether the enactment interferes in any manner "with the sale or other appropriation of the lands belonging to the Crown within the " said Colony, or with the revenue thence arising?" and this question must, in our opinion, be answered in the negative; the lands referred to being Crown lands, in the ordinary sense of the term, or lands already the property of the Crown, and not the lands of others, liable only to come to the Crown on forfeiture and escheat.
