Doctors' Commons, April 23, 1862. MY LORD DUKE,
I AM honoured with your Grace's commands, signified in Sir Frederic Rogers' letter of the 16th April instant, stating that in another letter of the 16th April instant he had returned to me for my consideration, by your Grace's direction, the draft of And he the Letters Patent by which it is proposed to appoint the Bishop of Colombo. was also pleased to state that he also enclosed the copy of the form of appointment in use in India, which was furnished to your Grace by the Vicar-General, Dr. Twiss, and to request that with reference to the explanations conveyed in that letter I would furnish your Grace with my opinion whether it would not be practicable to substitute for the St. Helena Letters Patent, as framed by me (a copy of which he was pleased to return), a form still more simple than that now proposed for Colombo.
Sir Frederic Rogers was also pleased to state that there is no necessity for revoking any part of the existing Letters Patent erecting the Bishopric of St. Helena, nor for requiring in the case of Dr. Welby, the Bishop designate, any other form than that prescribed by those Letters Patent in the case of Dr. Claughton. And that it would seem, therefore, only necessary to appoint Dr. Welby, to require the Archbishop to consecrate him, and to declare that all the provisions of the original Patent should be applicable to him as successor to the first Bishop. And that your Grace, therefore, directed him to request that I would take into consideration the annexed form, and would furnish your Grace with my opinion whether it would be effectual for its purpose and could properly be adopted.
In obedience to your Grace's commands I have taken these papers into consideration, and have the honour to

That I am of opinion that under the peculiar circumstances of the case, the annexed form of Letters Patent will be effective for its purpose, and may properly be adopted.
