(2.) Every person required by this section to make a report who fails forthwith so to do, shall be liable, on summary conviction, to a fine not exceeding twenty-five dollars, or in default of payment to imprisonment for a period not exceeding one month: Provided that no person not required to make a report in the first instance, but only in default of some other party shall be liable to any fine if the Court is satisfied that such person had reasonable cause to suppose that the report had been duly made and be- lieved that it had been made.

4. The Captain Superintendent, upon receipt of the report mentioned in section 3 of this Ordinance, or upon discovering that any inmate of any premises is suffering from venereal disease and that no report as required by section 3 has been made, shall forthwith issue a notice (Form A) requiring the person reported or discovered to be suffering from venereal disease to furnish him, within twenty-four hours from the time Weekly

Such person certificates. if certified to be diseased, shall, if so required by the Captain Superintendent, furnish that officer once a week with a doctor's certificate of state of health until a certificate signed by a doctor has been furnished to the Captain Superintendent stating that such person is no longer diseased.

5-(1.) The Captain Superintendent, in lieu of requiring subsequent weekly cer- tificates under section 4 of this Ordinance, may at any time (Form C) order the person certified by a doctor to be suffering from venereal disease to go to the Government Civil Hospital to be treated without fee either as an indoor or as an outdoor patient accord- ing to the discretion of the Hospital Authority; and such order shall remain in force until the Captain Superintendent is furnished with a certificate from the Hospital Authority stating that such person is free from venereal disease.

(2. Any person who shall, without reasonable excuse to the satisfaction of the Magistrate, fail to comply with the aforesaid order within twenty-four hours of the service of the same, shall be liable on summary conviction to a fine not exceeding fity dollars or to imprisonment not exceeding one month. If such person is sentenced to imprisonment, the Magistrate may, upon receiving a certificate from the Surgeon in charge of the Gaol that such person is suffering from venereal disease, order (Form D) such person

to be detained for the rest of the term of the sentence in the Government Civil Hospital. If, before the expiration of the term of the sentence, the Hospital Autho- rity shall report to the Captain Superintendent that such person is free from venereal disease, the Magistrate may, on the application of the Captain Superintendent, make an order (Form E) for the return of such person to the Gaol, there to undergo the remainder of the term of imprisonment, or may discharge such person. Should, however, the Hospital Authority, shortly before the expiration of the term of the sentence, report to the Captain Superintendent that such person is still suffering from venereal disease, and will not be in a fit state to be discharged at the expiration of such term, the Magistrate may, in his discretion, on the application of the Captain Superintendent, and without calling such person before him, make an order (Form F) for further detention in hospital until it is reported by the Hospital Authority to the Captain Superintendent that such person is in a fit state to be discharged, or until such person shall leave the Colony.

6. If any inmate of any premises who has been reported to the Captain Superin- tendent to be suffering from venereal disease, shall fail to comply with any of the re- quirements of section 4 of this Ordinance, the Captain Superintendent shall forthwith summon such person to appear before the Magistrate, and such person shall, on sum- mary conviction, be liable to a fine not exceeding fifty dollars or to imprisonment not ments of exceeding one month. If such person is sentenced to imprisonment the Magistrate may, upon receiving a certificate from the Surgeon in charge of the Gaol that such a person is suffering from venereal disease, order (Form D) such person to be detained for the rest of the term of the sentence in the Government Civil Hospital. 7. 9. Upon complaint laid before a Magistrate by the Captain Superintendent that Summary any house or portion thereof used as a brothel or lodging-house for prostitutes or jurisdic disorderly persons is situated in the immediate vicinity of a public school, or is used to the annoyance of two or more persons residing or having offices in the vicinity of such Order to house or portion thereof, a Magistrate shall have and exercise summary jurisdiction in dis respect thereof; and it shall be lawful for a Magistrate to issue a summons to the continue tenant, occupier, or keeper of the house or portion thereof of which complaint is made, and upon the hearing of the case, if the Magistrate is satisfied that the house or some portion thereof is used in the manner complained of, and is so situated as aforesaid, or is so used as to be a source of annoyance to two or more persons residing or having offices in its vicinity, he may order the tenant, occupier, or keeper to discontinue such use of it, and if such order is not complied with within such time as the Magistrate may by his order fix, the Magistrate may impose upon such tenant, occupier, or keepér a fine not exceeding fifty dollars for every day that the house or any portion thereof shall be su used after the time fixed by the Magistrate's order.

The provisions of the Magistrates Ordinance, 1890, relating to summary procedure shall apply to proceedings under this section.

The provisions of this section shall be in addition to those contained in section 4 of Ordinance No. 6 of 1894.

10. Upon receipt by the Governor of a report by the Captain Superintendent that Banish- ment of 'any house or portion thereof is used as a common brothel or lodging-house for prosti-

11. (2.) A copy of such order shall be affixed to the premises mentioned therein, and such affixing shall constitute due service of the order. Any person found, without the permission of the Captain Superintendent of Police, in the premises mentioned in the order after the expiration of forty-eight hours from the time of affixing such order, and until such order shall expire, shall be liable, on summary conviction before a Magistrate, to a fine not exceeding fifty dollars or to imprisonment not exceeding one month.
